    The case I couldn't think of earlier is fitzpatrick v sterling housing: iot represents the current law and lists all the relevant factors other cases build on this x

    Fitzpatrick v Sterling Housing Association LTD is case law pertaining to tenancy rights, it is irrelevant to benefits.

    It is not irrelevant, as you have demonstrated in your list of factors (whilst not the same situation, Fitzpatrick could be persuasive authority). You do not make the decision as to whether you are genuinely living apart, the LA/ JCP do.

    I was told by a third party that 3 nights is allowed before you are considered as cohabiting.
    Also .. I lived with my bf for 6 years untill we drove each other round the twist, we have been happily living a part for 2 years now and our relationship is great, we only see each other when we want to, not because we have to.
    Saying that most ppl don't get it LOL
