no MOT car is write off, 1st central not paying

Opinion is one thing, but this is not an appropriate thread for guesswork, assumption and urban myth about technical motor insurance issues. The OP asked for assistance and he/she has been without their car for over 2 weeks now, unsure as to whether any claim will be paid. I think everyone would agree that what the OP requires is accurate, informed advice and information rather than unsubstantiated opionion masquerading as fact.0 -

There is no onus on the policyholder at all to prove this. It is up to the insurer to prove this if they want to decline the claim.

So after 10 pages let me see if I've understood the situation ...
I'm driving down the motorway, not speeding as it's pouring with rain. My MOT has one week before it expires and being an avid MSEer my tyres, which I know need changing before the test, are using up the last few fractions of a millimetre of tread (no point in spending cash before you need to!).
Suddenly the motorway comes to a halt, as they do, and the guy in front is able to stop comfortably on his new tyres but though I'm not speeding or travelling particularly close I can't on my bald as a badger's @rse ones and rear end him. It turns out his MOT inadvertently expired the week before though his car is perfectly road legal.
So he's not insured and it follows it must be his fault ... makes perfect sense to me.

You would be at fault in that type of accident so the car in front would claim off you whether or not he was insured or not0
