The phones faulty then argos should replace or repair, if they choose to repair then you can argue this will cause you significant inconveniance and you do not wish the repair but a refund if they cannot replace it. It doesnt matter what Argos policy is.
" the repair or replacement must be carried out within a reasonable time and without causing significant inconvenience to the consumer. If this does not happen or the repair or replacement is not possible, then the consumer can rescind the contract (claim a refund) or request a reduction in purchase price."

How long have you had the phone???
But they didnt mention about asking for a refund did they.
Thats why I never mentioned it. :rolleyes:0 -

The fault can easily be found if switched on and tried as it cuts you off on calls , i do not simply want to go through the hassle cause i want a new phone.
Im quite happy with this model and i dont like the new range of phones Argos has this year so i didnt simply want to do it cause i fancied a change.
I went out of my way today for nothing and i have more important things to do in life then try to claim a phone is faulty when its not ,plus like i said its like new ...if they could repair it in a day or 2 then it would be fine but 14 days is to long.
I wasnt in the mood to argue as it look as if someone had already upset her hence she took it out on me :rolleyes:0 -
U never originally said you had to argue the point that ur phone was faulty.
And if they havent got your phone in stock and offered you a repair thats not being awkard thats being helpfull.
U now say you dont like the new range of argos phones yet because they didnt have yours in stock you wanted to swap it for a alternative one.
Am I the only one a bit confused here?
At the end of they day its upto 14 days to get your phone fixed. IT might of been done in a week it just depends.
Either way its better then going home with a broken one.0 -

Well with some people it does not take much for them to get confused
I would rather have an alterntive phone then wait upto 14 days , its ok because i will be ringing head office to make a complaint about the person in question because her attitude just stank.
Yes she was being akward , because how is me waiting upto 14 days helpful , the most helpful would to give me a refund or to replace with another phone.
I will want a refund now so i can take my custom else where.0 -
I took a faulty phone back to Argos. It was just a few days before the 12 month deadline. They gave me a full refund.:T0

Argos will still not replace told me becuase they said its there policy to send it for a repair if it can be.
Even when i said about trading standards apperently they wasnt intrested
Argos said they know the Law otherwise they wouldn't have a repair facility.
Just spoke to my friend who is a solicitor and he is doing me a letter i dont like to bother him with petite things like this as he has enough to do , but quite frankly had enough of there attitude.
Thanks for everyones input.0 -

I'm sorry, but how long do you think these things take to repair?
They have to be sent off, stuff looked at, and sometimes parts ordered, then sent back to the store.
1 or 2 days is unreasonable.
14 days is perfectly acceptable.
And you never suggested you wanted a refund, so the woman in the store was responding to your complaint the phone is faulty and you wanted it replaced. She is not to assume you want a refund!
And your 'solicitor friend' who's doing you a letter is wasting his time. If you went to ask for a refund you'll get it providing you have the receipt. Argos cannot replace something they don't have. It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

Actually when i was informed it wasnt in stock i said fine then please give me a alternative item or refund , i was told this was not possible as it was there policy to repair the item if its available.
14 days is unreasonable for a home telephone , told me i couldnt even have a cheap temporary replacement0 -
But I think you'll find that the statement quoted earlier covering the sale of goods act, shows that argos have acted in accordance with the law, by offering you a repair. The salient point is the use of the word "OR", which means that a refund is subject to the discretion of Argos, and that it is legally only required to refund following unsatisfactory or the inability to repair. As repairs are NOT carried out by Argos themselves, 14 days is an acceptable timeframe in the eyes of the law.
The law does not determine being without a home phone for 14 days as significant inconvenience, unless you can prove financial detriment without it.sale_of_good_act wrote:" the repair or replacement must be carried out within a reasonable time and without causing significant inconvenience to the consumer. I had a monitor that went after only 12 weeks that I bought from Argos. I was given the same line about repair only, and phoned Trading Standards and their HO from the store. Bottom line was they weren't budging with a replacement or refund despite it only being 12 weeks old. I was in there til after the store closing time, so by this point they couldn't do anything about it and I had to return the following day.
I went back the following morning with the monitor to have it sent off for repair, and at this point they actually offered me a refund as they didn't have another monitor in stock. I think I was extremely lucky with this outcome and ensured I phoned the manager to personally thank her and apologise for how I reacted the day before. I had spouted various things such as Sale of Goods Act, but as Trading Standards told me themselves, Argos are doing nothing wrong by offering a repair only.
I think you're gonna have to face the fact that it will have to be sent off, and buy the cheapest phone you can, which are only a couple of pounds from Tesco or Asda, to see you through the 14 days.0
