Argos will not exchange

I went into Argos today as i had problems with my phone which cost me £80 , i had my receipt and it was within the 12 month warranty.
But when the girl at till asked someone who i presume was manager and she came back and said cause my item is not in stock i will have to have a repair and it could take upto 14 days ...so they are telling me i have to wait 14 days without no phone!!!!
The phone is like still like new no marks or anything so i dont know why they wre beong akward
I have loads on at the moment and i depend on my phone , i was really annoyed and just took my phone back.
The manager looked so misarable i couldnt be bothered to argue i just went to phone Argos to complain but its now closed
Can they do this?

Yes, I'm afraid so. They have no obligation to replace, and have offered you to deal with the repair. Best advice is to buy a cheap phone (CPW's shop ones tend to be unlocked) and sell it on when repair complete.0

Its a home phone ,dont worry im going to try other other Arogs store untill it does get replaced0

Sorry but I dont see what you expect them to do if you phone is out of stock.
You could use the website and put the cat no in and check ur local stores for stock.0 -

Well they done it in the past before so why not

I dont see the big deal ...think its unfair to leave me without a homephone for 14 days when the phone is faulty ...but i probably just have to buy a temp phone from then and once my phone is repaired take the temp phone back and get refund within the 16 days money back

Well no if you speak with trading standards they will tell you this.
The phones faulty then argos should replace or repair, if they choose to repair then you can argue this will cause you significant inconveniance and you do not wish the repair but a refund if they cannot replace it. It doesnt matter what Argos policy is.
" the repair or replacement must be carried out within a reasonable time and without causing significant inconvenience to the consumer. If this does not happen or the repair or replacement is not possible, then the consumer can rescind the contract (claim a refund) or request a reduction in purchase price."

thanks for that Zorber , it was less then 12 months ... i dont have long before its up , the phone is like new so its not like im trying it on cause its all marked and dented.
Think she thought she could spin me a yarn cause im young.0 -

Print off the link i put up and take that into Argos saying trading standards gave you it, should get a refund then buy which ever phone you want.

woolworths do the same now after 28 days we were getting thousands back a year after like 10 months becuase people fanicied a new one - so now they are all repaired within the first 12 months the number of returns has dropped in my store by 80%0
