But they will watch out for the seller driving the car now.

    Very unlikely.
I doubt your friend was really interested giving he wasnt notified in a professional capacity and hence acting upon this information would be questionable.

I think you can probably substitute "policeman Friend" for "Bloke down the Pub"

Thought what everybody knows it is an offence to drive a car without tax or MOT and this listing states no tax or test.
Nothing to think about really if the owner or anybody else without trade plates drives the car in the listing they are breaking the law.
What is so wrong with being a law abiding citizen and being upset when other people break the law.
Everybody complains about the state of the roads in this country and it is the road tax that pays in part for the roads upkeep so why is it so strange for someone to complain about a person who is not paying their way.

    Ok George, Ill bite...

    1. car is on private land, so not on the road, hence not needing tax or test.

    2. Seller states used daily, but this could mean before the tax/test ran out.

    3. How do you know who is going to collect that car and how they are going to collect it? (especially as the auction hasn't yet ended!)

You can be as upset as you like but the seller is doing nothing wrong at this stage. Unless you are suggesting his local constabulary go and sit at the end of the sellers road on the offchance he gets in it and goes for a spin? In which case I think my taxes can be put to much better use.

    OK I will answer.
    1. car is on private land, so not on the road, hence not needing tax or test.

    A. But who's to say the owner is not driving the car at the moment a photo cannot tell us this plus no mention of a SORN being filled in on the listing to declare the car off the road.

    2. Seller states used daily, but this could mean before the tax/test ran out.

    A. But it could mean that they are driving it now and everyday untill it is sold.

    3. How do you know who is going to collect that car and how they are going to collect it? (especially as the auction hasn't yet ended!)

    A. No one knows this so I will give you that one and this is not the owners problem anyway.

And in answer to your final point no one would want a stake out over car tax evasion but police cars are fitted with number plate recognition cameras and there are also some of these cameras mounted in towns and once on the system if the car is spotted then the owner or whoever is driving the car can be arrested.

Also you mention that the owner has not broken any laws yet maybe not but if a SORN declaration form has not been filled in for this car the owner has broken the law and can be fined for not correctly declaring the car as off road to the DVLA.

George, there is a small chance my next door neighbour may head out on a murderous rampage tomorrow. He may then drive to Tesco (insured of course) and shoplift 2 carrots and a crunchie. Today he came home with a Sainsburys bag and its possible he may have stolen something from there...

You are basing everything on "what if" The law doesn't work to "what if".

I am not making any assumptions at all but any car with no tax on it must be declared as such with a SORN declaration form this is a fact.
Once proccessed the cars registration is fed into the police number plate recognition camera system fact.
Any owner of a car with no tax and that has not been declared correctly with a SORN declaration form can be fined fact.
This listing states the car has no tax or MOT but does not mention it being legally declared as off road fact.
And while we talk about what if scenarios you are all making the assumption the owner is innocent he may not be.
And to answer the question the law does not work to what if I would say that it does judging by all of the cameras in our town center that are only there in case we commit a crime.

Maybe because in this country we are all 'innocent until proven guilty' and quite rightly so.
