Have to say, I'm not sure what doorsteps have to do with anything...
The legislation you have referred to won't apply as the 'cooling off' periods have, in any event expired.
We're back down to good old contract law.
The legislation i was referring to didnt just cover "cooling off" periods which have well since expired, but also to cancellations........a cancellation under "breach of contract" (which the supplier could argue but imo would be stupid to even attempt it) is still a cancellation. You keep using that word. And just because you havent seen them doesnt mean it doesnt .
Read the article you referred to.0 -

As a matter of law, that is absolutely not correct. A cancellation is a right - whether contractual or statutory based.
A breach entitling the other to repudiate the contract is a completely different matter.
Or at least that is what I was taught on my law degree 17 years ago.0 -
You have no clue as to my qualifications or education. I will not enter into a "!!!!ing" contest with you as i have found that you cannot reason with people who lack common sense (for instance common sense would have told you that legislation can change one week to the next, never mind within 17 years.......just as my common sense tells me it is entirely possible you are lying and for all i know are a spotty faced teenager who works at Burger King).
I am confident not only as a person but as a professoinal. Ergo, i dont feel the need to polish my own apples, especially to try and "big up" myself on a internet site and try and make myself look more important than another human being.

I thought a 30 day cooling off period is if the customer changes their mind? In this case the customer has not changed their mind, they have been told that the company can not provide what they ordered, which is different.
The sticky bit being that its taken the company 8 weeks to inform the customer, in which time the company may have already manufactured the frames. (OP says they thought the phone call was for installation) The company should have informed the OP as soon as they discovered the frames could not be made as ordered, giving the OP the time to cancel.
My suspicious side would suggest that someone in the workshop mis- read the order, and has made up the frames with a different finish, and the company still want to flog them to the OP!0 -
No they wouldnt have a cooling off period of 30 days and the one thing we pretty much all agree on is that they are well out of the cooling off period lol. Very rarely do you get 30 days cooling off but this depends on what you're signing and where you're signing it (ie home, work, suppliers place of business etc).
The OP hasnt said they are unwilling to cancel, i think he just wanted to know how long a refund can take, given that they took 8 weeks to inform him they couldnt supply the goods as ordered (which is essentially a breach).
And i know first hand of what companies are capable of. He hasnt mentioned what kind of windows but double glazing companies are the worst. There have been instances of them refusing to acknowledge customers statutory cooling off periods, ordering the windows/frames, dumping them outside the persons house and charging them anyway. That is just one of many. Unfortunately they give the good, decent double glazers a bad reputation also! You keep using that word. I would endorse the comment to chill a little.... It's an anonymous internet forum.
I'm sure you mean well. Legislation doesn't change from week to week in this country. Thankfully.
Equaliser posts from a position of knowledge. DOn't know the guy but he seems to be able to speak about principles of law which are pretty sophisticated - I struggled with understanding the difference between repudiatory breaches and breaches entitling recission at Law School - so I think it a bit unfair to challenge him/her on this basis.
I also think you have been a bit unfair on BK employees....0
