I think my next route will be to email her with the original sizes i provided, and the measurements of the actual dresses asking for a refund, and I will send the dresses back.
Do you think I should give her a time limit for this refund and if she doesn't get back to me that I will be taking it to small claims court.
We looked at adjusting them, but to get them even half decent it would have cost another £50 a dress, and unfortunatly 3 of the 5 couldn't even be asjusted as they are too tight and have no 'give'

The dresses were brought from an england seller, however she aparently use's a tailor(personally they look shop brought but...who am i to judge)
The seller is an english seller, and I am now feeling that she deliberatly sent them late post on the day so i couldn't claim if something was wrong...I did not know about the 45 day think or i would have been much more weary, but i was contantly in correpondance with her to find out how long they would be etc, five dresses are a lot to 'make'
Back to me emailing her, would that be the best way as I wouldn't have a clue how to contact her via letter, but if i could would be much better as i could send it recorded/signed so i know shes received it. Anyone got any ideas?
I would like to say a huge thank you to all of you who has made suggestions as I can relax a little now. Hey, if all else fails i'll have to still them back on ebay and see if i can recoup some money....doubt they'll sell though being so short!!!!!:rotfl:

For me there is only one route - small claims - do a search for "Letter before Action " template - then write a letter to her - giving her 14 days to refund. Keep it simple. Don't get emotional.

Is there anything else apart from them being the wrong size? Is it significant? And i may have missed it if you answered the previous poster asking but is the seller a private seller or a trader?
And paypal may restrict/close your account if you action a chargeback with your bank as effectively, the seller has your money, not paypal. Within paypals terms, you are not entitled to a refund as it is outwith 45 days (not sure if this could be seen as unfair contract terms given that you didnt receive the items until the 45th day and therefore it impedes your ability to enforce your entitlement as set out by paypals terms? anyone any opinions?). If you action a chargeback you are essentially in breach of your contract with paypal.
Did you contact the seller withing 7 days of receiving them to say they werent suitable?
And DebtHater......if you read her original post you'll see she didnt receive them until 45 days after ordering, not that she had the dresses and waited 45 days
also @ OP........what type of listing was it on ebay? Buy it Now, classified ads, auction? The type of listing can affect your rights too.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

Yes, thankyou, I understood that. But my question was, why did the OP wait for 45 days before querying with the seller as to where the dresses were? Surely it doesnt take more than 45 days to make some dresses?0 -

Its only 9 days a dress. Depending the style, materials, dressmakers waiting list etc then its quite reasonable.
As for the 45 day limit, thats the exact reason i queried whether it could be seen as an unfair contract term. IMO if she can prove when she received the dresses and can either confirm correspondence with the seller OR that they arrived when the seller originally stated that the 45 days should start from then or Paypal should have at least investigated. Fair enough its not covered by their terms but to me it just signals a blatant disregard for customer service.

You can't possibly make that call. We have no idea how much work went into each dress, if there was individual embroidery on the dresses etc. A high street dressmaker will quote 6-8 weeks on average.
The seller could well wait until 45 days, and that could be the plan. But 45 days for five dresses is still an average turn around time.
Edited to add, delivery on this site is 5-12 weeks
