Ebay/paypal big issues :( want to cry!!! help!

Right, this will be long and boring but i have gotten myself into a right state.
(This is for a wedding)
I ordered handmade dresses from ebay on the 16th April, they were all custom made, size wise. We had a dress maker take all the messurment.
The dresses didnt arrive untill end of may. tried on said dresses.
Not one of them fits. They are all too short, to the point where they wouldnt have to bend over to look indecent.
Two are too big
Three are to small and don't fit at all.
I've tried to contact the seller and she's ignoring me. So i though paypal. But now being told can't dispute after 45days from payment....which isnt fair as i didnt recieve the dresses till the 45day!
Im so so upset and stressed at this, and i honestly dont know how to get my money back now. I am happy to send the dresses back as they are usless.
The are not fit for purpose. They have not been made to the sizes i asked for/required.
What should i do?

I think you need to re-read their post, they had a professional take the measurements, so by the sounds of it the dresses are not made to specification.
Is this woman acting in the course of business or not? How did you pay?Back by no demand whatsoever.0 -
I would check the measurements of the dresses against the sizes provided. That way if the dresses are too small then it the dress maker at fault...
If they match with the sizes given then its either the measurements wrong in the firs place or a change in size since they were taken.
Weddings are stressful and I am sure you could be doing with out this, having found the dresses you wanted, i doubt you want to start looking over again. If it was a case of slight alteration then I would have it sorted and forgot about it, but if they all are short then I believe you have a good ground for dispute....however SOG doesnt cover all ebay traders.

I'm afraid the 45 day limit is shown on both paypal and ebay so in reality you should have realised this earlier. It's not there fault the items arrived when they did.
I'm guessing this was a chinese seller. If it is your only option is if you paid via credit card through paypal. There are 2 problems with this not all credit card companies will let you do this because you paid via a third party (paypal). The other problem if you do manage to charge back Paypal will close your account and you wont be able to have a paypal account again so be unable to use ebay.
If it was a British seller you may be able to consider the small claims court and contacting Trading standards.
If your wedding is close I would suggest you have enough stress and you leave your complaint and pursuing the company until after the wedding.0 -

While this is good advice, id advise the op to make some "durable" (ie letter) correspondence about the issue prior to the wedding to make sure it doesnt harm her claim. Otherwise the seller may just claim they used it for the wedding then only claimed after to get money back for used goods.

As others have said you need to check that the measurements on the dresses you have to hand are wrong. Assuming they are, assuming you have tried to resolve amicably and assuming your seller is in England, your next step is going to be to send them a letter before action giving them 14 days to issue you with a refund. If that fails then you will have to go through small claims court but this will only cost you £30ish so you have little to lose.0

I did measure them and not one is inline with our measurements.
Im just frustrated with paypal as the dresses didnt arrive till late night on the 45th day and I couldn't get round all five maids house to try them on. We did that the next day and i sent a message to pay pal the very same day but was rejected.
Why would i lose my paypal account if i requested a charge back from the bank? And would the bank actually even touch it?
I think my next route will be to email her with the original sizes i provided, and the measurements of the actual dresses asking for a refund, and I will send the dresses back.
Do you think I should give her a time limit for this refund and if she doesn't get back to me that I will be taking it to small claims court.

The seller is an english seller, and I am now feeling that she deliberatly sent them late post on the day so i couldn't claim if something was wrong...I did not know about the 45 day think or i would have been much more weary, but i was contantly in correpondance with her to find out how long they would be etc, five dresses are a lot to 'make'
Back to me emailing her, would that be the best way as I wouldn't have a clue how to contact her via letter, but if i could would be much better as i could send it recorded/signed so i know shes received it. Anyone got any ideas?
I would like to say a huge thank you to all of you who has made suggestions as I can relax a little now. Hey, if all else fails i'll have to still them back on ebay and see if i can recoup some money....doubt they'll sell though being so short!!!!!:rotfl:0
