"Not entilted to anything" Anybody else in this situation?

i will try to keep this as brief as possible
I have a problem with two of the discs in my lower back which has caused pinched nerves to my leg which causes great pain which prevents me from working .
I am living with my partner and have been for about two years who has a full time job , because i have not been working for a few years and not living at a permanent address or claiming any benefit i have not paid sufficient national insurance contributions to qualify for any benefits but i am officially claiming incapacity benefit or whatever the new name for it is as when i made my claim it was still called that about 2 years ago.
I currently receive no income at all because i have not paid sufficient national insurance which i accept and all i am entitled to is my national insurance contributions which are paid by the benefits agency whatever they are called. my partner has tried to claim tax credits because i live with her and i am on benefit, but because i do not receive any actual cash benefit she cannot receive any credits if i did get the benefit she would be entitled to her tax credits which would be a great help to us . So i am unable to claim anything and unable to work .
On the tax credits form she is entilted to credits if her partner is on benefit but this does not apply to us because although i am on benefit i receive no money.

    Have you worked your way through the 'Entitled To' website to double check the position?

    Are you saying that you are on Incapacity Benefit but it only pays your NI contributions? Have you been moved onto ESA?

    What is your partners income?

    If i fill in the tax credit claim form stating that i am on benefit she is entilted to just under £4000 but the tax credit person i spoke too said i am not on benefit because i receive no actual payment
    yes i am on Incapacity Benefit but it only pays your NI contributions i started the claim just before it changed its name to ESA
    my partners income is just under £18,000

    So you get IRESA as you don't have enough NI contributions to claim CBESA, and as you partner works full time you are not entitled to any ESA.

    Can't see how this makes you as a couple ineligible to claim tax credits?

    Can you confirm ages and what your partner earns?

    Ok just seen your other post she earns £18,000 she earns too much to be get working tax credits.

    What is the cut off point of income for Working Tax Credit?



    The cut-off point of income for getting Working Tax Credit is different for different people. The point at which you stop getting it will depend on your circumstances.

    For example, if:
    • You are a couple without children and
    • You are not disabled and
    • You and/or your partner work at least 30 hours a week
    the cut off point is £17,458.

    yes thanks for that but when you fill in the tax credit form either on paper or online if one of the partners is on benefit you do not have to give the working partners earnings on the paper form it says i quote
    "if at least one of you was receiving any of the above benefits for the whole of the award period and still is you do not need to give us any income details. go to part 1 of the form and tell us which benefit(s) you receive"

    and when you click that one of the couple is receiving some kind of benefit on the online form the box to put the working partners income disappears.

    so because i am on incapacity benefit the amount of her wage does not matter

    its just the tax credit people do not class it as i am on a benefit because i am not receiving any money.

    i am but they just pay my national insurance that's all, if i was not on benefit i would not be getting my NI paid would i?

    You do not get IB if you did you would get money no? you get your stamp paid.

    yes i understand but i still get letters every six months that say quote

    " to continue to receive payments of benefit you must meet the threshold of incapacity under the personal capability assessment"

    so i am actually claiming incapacity benefit.
