    Yes soolin unfortunatley I feel I will be out of time with this.

    Never realised that recorded was so bad, especially when the item has been delivered but it does not show online, that is awful and a complete waste of money.
    So she could have the item but knows how bad recorded is, so knows she can get away with saying she hasn't?

    She could have it relisted on ebay for sale, I will check.

    But she must know that I have her address..how do these people sleep at night!!

    Or the item may have gone missing in the post as post does go missing.

    Yes things do go missing in the post, I am aware of that cyberbob! I can't possibly know for sure that she has it or did not take delivery of it. But what a scam if she has eh!
    But she went to the trouble of scooping cheap, nasty cream, mixed with fake tan into a dirty pot and then attempting to sell it as an original...she's capable of deceipt.

    There is still a chance it is just delayed in the postal system, out of interest when you check online does it say it was 'accepted' by your local PO, at least that shows you have tried to send it back if anyone can think of any legal ways to persue this.

    However, realistically there is a good chance it is also lost in the post, as cyberbob says, it can happen. You will never know for sure either way.

    I know it is hard on you but this isn't paypal being awkward, this is just a logical way of dealing with it and the alternatives would be frightening. If I sell something and the buyer claims it is a fake it would be unfair for paypal to just say OK, destroy it and we'll give you your money back, the buyer needs some sort of evidence to prove the claim. Likewise if a buyer returns something for a refund it would be unfair to make me, as the seller, refund until I have the item back.

    was posted at Spar Supermarket BT19 1DL on 26/05/10 and is being progressed through our network for delivery". It has stated this for over 3 weeks now.
    I do not have a problem with Paypal, I agree they have to be fair. I am annoyed at RM and the seller who is extremely unreasonable and is accusing me of not posting the item even though she has the reference number and has seen the above statement online herself.
    I assure you that the item is fake and I have photographic evidence to prove this, but ebay are not interested as the seller has offered me a refund.
    I understand the problems a seller can face, but as a buyer I am in a no win situation which feels very unfair to me.
    Time is running out for me now and this seller has made £84.02 and probably also has the pot of '£2 cream' too, which she will put back on ebay in a few weeks time! It leaves a horrible taste in my mouth.
    These people who sell fakes on ebay are ruining sales for honest ebayers. Which is a real shame.

    Unfortunately you are now in a no-win situation but it isn't because the system is unfair, but because you didn't realise the rules. I'm not having a go, but it is wrong to place blame elsewhere.

    At the end of the day, your photos of a pot of cream do not prove it to be fake. The only proof would be from an authorised agent giving a factual statement. This is what Paypal require.

    Also, there is no evidence that the seller has the item back. Showing her a reference number does nothing for her. Put yourself in her shoes. Would you give a refund if you didn't have the item back?

    What is unfair, is making assumptions on the information as you see it. Actually when you look at the facts, it is a lot clearer.

    Well you can claim your £41 back from the Post Office for non delivery (and be persistent).

    Then you can leave a negative for the seller saying "face cream fake. Seller a fraudster. AVOID!"
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Trouble is, sometimes RM don't pay out if the item was above the capped value £41. Citing the wrong service being used.

    Ebay may take the view that this is defamatory and have it removed.

    And, to be fair, as I said ^ we don't know for sure if the seller has the item back.

    I am not taking the side of the seller, just seeing the FACTS rather than speculation.

    Royal Mail have no grounds for not paying out up to the limit of the service used. I don't know where that idea has come from. Think someone must have dealt with an employee who was just making it up.
    As for buying something worth £300 for £80 and then "expecting" it to be dodgy? If you really think that's not going to be genuine, don't use ebay at all.
    All you can do is make your claim, up to the maximum, and lose the rest. At least you won't do the same again.

    A while ago someone cut and pasted a response from RM on the Amazon seller board that stated there was no compenasation due where the wrong postal service was used. The book had been sent recorded and had a declared value of £90 (I think it was £90, it was ages ago now) and RM said that their terms and conditions required senders to always select the approrpiate postal service which for valuable items is special delivery.
