Advice needed re cyclist

    Hi wee willy harris...they said someone saw him in the road but no one actually saw him hit her car, in fact they apparently, initially, thought he'd been hit by a taxi suggesting they just found him on the road...

    Wayne, I think he realises that now but hindsight is a great thing...

    Tom, thanks...think that's what I'll do...send one last message saying something like we'd like to see evidence that he actually did any damage, crime ref number etc. If they did call the police there would be something ...

  • Yes - what exactly is meant by "unwell"? Was he under the influence of drink or drugs or was he genuinely unwell?

    I only ask because if it was the former and it was drink or something slightly stronger it could be a police matter. If it was genuine illness then its probably a civil matter.

    genuinely unwell...felt bit sickly...been sat in sunshine and prob dehydrated to be honest

    I would suggest if it was reported to the Police as an injury accident then they would have attended and there would have been some recollection by your son (blue lights and uniforms do that).

    thanks binsy...he has no recollection at all of anything like that...and..personally...i would have thought they wouldnt have let him just go off home..and would most likely have followed up..and possibly given him some paperwork too??
  • Why send them a text at all? Tom's advice was to not communicate any more, and I would be very inclined to agree. If they get in touch - officially that is - and by that I mean police contact, solicitors letter etc. then start to think about more communication.

    They made the last contact, if you now reply, that is tantamount to asking them to contact you again (whatever you say in the text/communication) You saying "I want to see proof" will be seen as saying "If he did it I admit liability" not neccesarilly by the law, but certainly by them.

    Say absolutly nothing, don't send a text, certainly don't call them. If they get in touch by any means at all, say that you would prefer all contact to be in writing. Never admit a thing - not that your son was out, what time he got back, what colour his bike is, what colour his hair is, the brand of soap he prefers - nothing. It is their job to prove what happened and possibly make a claim on your insurance - or sue you for the money. If they sue, let the magistrate decide, that is what he/she is there for - it's not going to cost you any more (other than the small court fee)

    SAY NOTHING

    It could be worthwhile to pop a call to your house insurance though to see if you are covered, as a bit of a back-up plan. Don't say he did it though - you don't know that he did - you have no proof.
    Unless it is damaged or discontinued - ignore any discount of over 25%

    Just another thought - what was the damage to the bike? Was it consistent with just falling off (few scratches etc) or driving in to a parked car (prob bent forks or whatever they're called)?

    I'd be more concerned about your son. 20 year old and has a total memory failure regarding a painful incident would certainly (imho) want investigating! If he blacked out for that long, worth getting checked.

    Hope he's ok and all gets sorted
