Advice needed re cyclist
Options
Hi...am new to this but hope someone can help. My son is 20, full time student with no income..we are not connected financially but he lives in my home. On Saturday evening he was at his sisters and began to feel unwell..it was quite late. He decided to cycle home, about 10 mins at the most. On the way home he became very unwell and somehow fell off his bike...he can't recall exactly what happened but he made ithome and went to bed. Hi face full of cuts, hands too.
Anyway..on Monday evening whilst both myself and my son were out a woman and older man came to my house and left their address with my younger daughter stating that when he fell off his bike he damaged a car. We went round when we returned to speak to them to see what they were talking about, as I said he has no recollection. The woman who came to the door stated that the car was her friends and that someone living across the road had seen him in the road and had been concerned, initially thinking he'd been hit by a taxi. Claimed they'd called for an ambulance. Claimed they'd called the police but had no crime ref number. She then gave me mobile number of the friend who i text stating that he didn't know if he had done anything but apologised if he had. She immediately claimed she was getting estimate for repair and would send it to us. I expalined that he has no income and I'm not liable for him.
We have no proof he actually did anything or that any damage was down to him.
Does anyone have any advice on what he should do?

Just let it run it's course.
He cant say he did, he cant say he didnt. It'll come down to witnesses and what can be proved.0 -
Thanks...prob is she just text again with a sigle quote..do we just ignore it? she's threatened to go to police but obviously nothing can be proven as u say. I'm tempted to just tell her to go ahead and take whatever action she wants but he can't pay0

It's not a criminal matter. The Police will (politely) tell her to Foxtrot Oscar.0

If he is deemed legally liable your home contents insurers will normally handle the claim0

ok...so police won't be interested...that's cool..as for contents insurance...would he be ale to do that as he lives with us ut pays no rent, pays no bills, and he doesn't pay the insurance??
.ultimately, could she go to small claims court??0 -
Ask to see the damage.Happy chappy0

Hi Tom...fair point but ultimately there is nothing to say he actually did anything...they state they called the police but had that happened, as far as I know, and my son had left the 'scene of an accident' they would have come round or contacted him as I'm guessing someone followed him home for them to know where to call to contact us at all.
Just have a gut feeling that there may have already been some damage and finding him unconcious near the car gave perfect opportunity to get someone else to pay...just seems odd that they reckon ambulance and police called. If that had been the case I can't see either letting him just go home if he had been as bad as they are claiming.
Just don't know how likely it is that a/police will be interested b/the woman will be happy to pursue through small claims and c/how they could prove he actually did anything?0 -
Well, they have at least one witness who says he did, and he (with injuries consistant with an accident) can't say that he didn't.0

I'd be inclined to do nothing.
If they can't give a crime number of any other information about the police or ambulance then I'd be suspicous.
Tell them to get that info and leave them to do the hard work.
You've already been too helpful. Don't communicate any more unless they can provide a crime number.Happy chappy0 -
