Why don't you let us look to lower the actual debt with unenforceability? What harm is there?

She owed £150,000 (yes, one hundred and fifty grand) 3 months ago - that was 18 accounts. Since we've been helping this is now 13 unenforceable, 4 outstanding and 1 enforceable - i.e. £100k+ better off already!
So in Ann's worse case, she's just wiped £100k off an impossible to clear debt (she is a pensioner with no income).

Numpty - those were the sort of letters i was looking for - thank you
Niddy - I think I feel a little unsure about the unenforcability as we are only 30 so I wouldn't want the debt to be hanging over us until we die and i think knowing it is still there somewhere would be too much of a weight on my mind. If we did try the unenforcability route on those that we can, would all interest and charges be frozen once we have started to dispute it? Would it then be possible to pay off the debts at a much later date if they were unenforcable? I know that wouldn't make financial sense but it would help me sleep at night. I think we are just in an odd position that if I get a job at either of the schools tomorrow then that could increase our income by £1000 so we could meet minimum payments plus a little bit more.
I started reading mouseann's thread 2 days ago when you pointed it out but I don't do skim reading so am only on page 8. I have a cuppa now so will try to let the kids entertain themselves whilst I indulge myself!
Still not heard anything from the co-op about the new bank account so starting to worry about that.

Well done on not buying the takeaway.. re the enfocability i would assume that once you declare its not enforcable then well i dont think you could then later pay it it my mean a massive influx of intrest added or somewhat i think or i would assume it would be gone after 6 years but as for credit rating i dont know how it would affect ... now in terms of money i really think you need to look at something everntuallythemortage willbe abck and unless you can dent some of the debts so thatthe amount you pay out is manageable you may start a rapid decline to something you dont want and i dont think that would be something i would want to see... i hope writing tothe companies will help re intrestif not i hope you have the opportunity to offer token payments xxI AM A MONEY MAGNET, THEY ARE MAKING MORE MONEY FOR ME AS WE SPEAK:pMIKES MOB, DFW NERD 1071, DFW LHS 132!MIRACLES HAPPEN I'VE SEEN IT WITH MY OWN EYES. if DW gets a job tomorrow then we could make the minimum payments from November (with the mortgage) and therefore use the money we are saving now to pay the mortagage from nov to feb to reduce some of our debts and therefore reduce our minimum payments, which would then allow us to pay off more than the minimum and start to make a dent in our debts.
Spoke to my parents about childcare yesterday and they have said 3 days would be ok. I did mention about their quality of life and the massive commitment they are making, but they said they couldn't leave us stuck if they could help us in any way.Est. debt free day April 2016 (ish) Debt at June 2010 £34,247.13

I think, if I have been reading correctly, that it is defaults that expire after 6 years but the actual debt would always be there - they just wouldn't be able to chase us for it. I think what i am thinking (does that show how puddled my little brain is at the moment - I don't 'know' what i am thinking) is if we used unenforcability one some of the debt I wouldn't want it to remain there for another 60 years - i am guessing that once it is unenforcable making any sort of payments towards would be a huge, huge no-no but saving up the balance could be done and then when we are in the position just paying the full balance to get it off our consciences.
I have looked again at our SOA and based on where we are now and savings we can make as of September then we fall short by £830 if we are paying the mortgage. There are further saving to be made when contracts are up for renewal towards Xmas but I don't want to over plan too far in advance. Yesterday's budget means DH's payrise in September won't be happening and we have applied for Working Tax Credits but not heard anything yet and these would be cut next year so don't want to factor anything in there either.
If I work for two days then we would be left with a shortfall of £100, which should be attainable through business, ebay and so on.
If I work for three days then we would have an extra £265 to put towards extra debt repayments beyond the minimum.
I think I just get restless with doing nothing at the moment but tomorrow evening when I know what the 2 schools can offer us then we can reassess the situation more meaningfully and redo our SOA for September. I am just getting myself into a tizz in the meantime.
