Bank not allowing me to access my money!

My bank has stopped me from withdrawing my monies out of my current account until I have paid my credit card bill off in full!

I did not receive any information on this action via the post, I found this out when I phoned them up about my card not working in a bank machine on Tuesday.

Can the bank do this?

If you have defaulted on any money you owe them they are entitled to take money out of any other accounts you have with them.

However, they are only allowed to take the amount you have defaulted. If you miss a couple of payments they can't make you pay off your whole credit card.

The way they have phrased it is unusual. They would usually move money from a current account or savings account and use it to pay off the card.

Have they definitely told you that you have to pay off the whole balance? Have you defaulted on your credit card payments recently?

Yes I have defaulted on my credit card and yes the in house call centre has told me that I must pay it all in full before the stop notice is removed.

I did offer to pay half of the sum owned on credit card off now and half when I received payment owned to me.

Also, I was not told by the bank that they would make any changes for refusing direct debts on my account due to their actions. I think that this might be the case.

Finally someone senior was meant to phone me back tonight and did not.

They won't give you any notice that they will do this as it will give you a chance to move the money out of the account. That explains why they didn't write to you about it.

They are just trying it on by telling you to pay off the whole balance. They are entitled to make you pay the whole amount that you are in arrears, but not the whole balance.

Pay off the amount you are in arrears and then make a formal complaint.

    Thank you very much.

I will e-mail the banks big boss tomorrow, phone up and recorded the conversation and offer them the arrears.

I have already registered a complaint with the FOS.

Somebody might come along and post some additional comments or contradict what I say so give it some time before you start making calls.

You will have to exhaust the bank's complaints procedure before the Ombudsman will get involved.

The FOS have given me a case number already, also when I told the person what happened he said that bank should not taken this action.

Also when I talked to the bank I was told that they did not have to give me notice. But when, I said a letter should of been sent before the stop order happened. I was told a letter should of been sent to me as courtesy thing. But I said that a bank would not do something if they did have to? I said that their procedure had not be followed and why would a bank do something did not have to do legally? He had no answers.

I would open an account elsewhere as well and if you get no satisfaction soon switch wages and direct debits to it.I doubt you will have much time for your present bank after this so choose well.ie not Santander
I have a deep burning indifference

And those comments just go to show that this is nothing but a troll posting !!!

The FOS do not entertain any complaint until the banks own internal procedures have been complied with and that take a minimum of 8 weeks !

What is it with this site if you can not make a useful comment do not make one. :T

I did and was given a FOS number, maybe the guy that picked up my call was new and did not know what he was doing?

Anyway, I think I will go with willing to pay arrears not the whole amount this action has caused me financial hardship etc.

The bank can do it, the FOS know they can do it so they wouldn't even look at your non-complaint. Utter claptrap!
