Hi all
I have read all your posts so feel I know you all (well a bit anyway). Kindred spirits - we are all going the same way in life hopefully.
I am going in to my second year of DMP and may be debt free before I retire, if the kids don't spend the little that I have got.
I just hope that I don't get one of 'those' letters from the tax man. He can send me one of the others anytime.:D

Although you still have the worries and the day to day drudge of trying to make ends meet on a restricted budget, peace of mind is the pearl hidden away in the oyster! (Yea, like we could afford to eat expensive raw molluscs)
Peace of mind is priceless. A DMP is not going to be the right choice for everyone, but how much better than sticking your head in the sand?
Whilst on my mini-jolly I read an article about a man who lived in his shed for a year to avoid baileffs etc. How sad is that? You can't hide from it - in the end you've got to face up to it and fight.

Hello,
Well I have to admit I was stupid in thinking I could hide from a debt from 1998. Took a loan out and struggled to make payments 14 month into a 5 year plan, therefore, ending up going a debt management agency (Debtbusters) in 2000. They were basically rubbish so I arranged my own from 2001 until 2003 but moved house 4 times in that period but did not update my details with the creditors. I had a few difficult months and lowered my payments without informing them which became my regular payment amount. In the past 7 years I have received no correspondence from the creditor (nor did I attempted to contact them) until I received a letter from Debt Managers Ltd. Spoke to them earlier and the creditor has passed over the debt.
I am currently on DMP with Payplan following redundancy and excessive spending but the above was not included. What a fool!! Hopefully Payplan can reconfigure this debt into my repayment plan but the representative from DML was adamant that they require two payments of several thousand immediately.
Has anyone had similar experience or pointers on what to do? Any feedback would be appreciated.

Thanks Twithead for your reply. I'm a great believer in things happening for a reason. Before I went onto the DMP every day was a struggle in terms of where can I find the cash to pay all the bills and CC's, we had no money and no quality of life. We never went anywhere or did anything as we had no money. Going onto the DMP has given me that peace of mind and although I still don't have a lot of money at least my mind is not continually thinking up ways to pay CC's and I will be debtfree before I retire which was always in the back of my mind as another worry

Been taken to court by Nationwide and they have a CCJ awarded for £85pcm - I have been paying through a DMP Payplan for the last 10 months and have never missed a payment.:mad:
I will be seeking a redetermination from the court on the basis of fairness to my creditors and the income expenditure not allowing for such a significantly higher monthly payment.
any advice, links etc? - what can I expect will I/ should I have to attend court and present a "defence" of some sort?

Just had another statement from Nat West for the OD showing that the interest and charges heavily outweigh the monthly DMP payment. Should I send another letter asking if they'll stop interest. We are 2 months into the DMP i'm hoping this is normal but I just want to cover every angle so all advice welcome.
Grantalien i'm intersted to hear the reponses to your question as its something i've though about myself ie if you have to pay more as the result of a CCJ does that mean the end to the DMP?

This is so incredibly true! I have had moments where I need to do some follow up with a creditor in the form of a letter (we manage our own DMP), and I sometimes think "I just can't deal with this today, I'll worry about it tomorrow or next week" and then I have to stop and remind myself that it was that "head in the sand" "I'll deal with it later" mindset that made it get so bad to begin with. After the letter is done and ready to post, I just feel so much better, in control of things again. Some days it can really seem like you're beating your head against a wall dealing with the creditors, but I've found that if you try to keep on top of it and get things done in a timely manner, it's so much more manageable and so much less stress. My OH and I are doing our dmp which has been going quite well with the exception of scalifax :mad: they keep putting my oh on an informal arrangement with a review every 3 months. So we paid the monthly amount on time, review was due in July never heard anything. So we wrote, and wrote again. Never heard a word, interest and charges reappeared. Today OH gets a default letter saying if we dont pay over £1,000 by 23rd September they will either a)pass the account to a DCA or may take him to court:eek: So I rang as my oh has given me authority to talk on the account, we never received your last letter they said. So today, I sent another copy of our last letter dated 11th August, along with the default letter sent today special delivery which cost me a fiver!!!!
They make me sooooo :mad::mad:. So I we have now got to wait for a reply from this letter now. So what I am asking is, has anyone here got any experience with scalifax? do they just pass your account on, and do they carry out their threat of court? my oh suffers from stress, depression and ME so cannot deal with this as well.

I hope not! - I am seeking a redetermination which will mean a meeting with me, creditor and the judge (i think) - explain how I can only afford the amount offered (and paid for the last 11 months) and the fact that there needs to be parity in what I am offering to the creditors.
I also imagine that if the court uphold the higher amount then this would become a priority debt - I don't really want this happening as I dont want my current payments to dip.
thirdly - I understand that I keep paying nationwide and the balance reduces as part of the DMP until the redetermination is made or not!
Hopefully the court will see sense as a change like this could have a dramatic impact on my DMP and my other creditors!:mad:0
