I'm not sure from the above whether you've paid anything towards this debt recently but if you haven't paid anything or acknowledged it in writing for over six years then the debt could be statute barred. Have a read of http://forums.moneysavingexpert.com/showpost.html?p=11571227&postcount=3
Hello,
I have made regular smaller monthly payments to the creditor for the past 8 1/2 years. Put my head in the sand and hoped they'd go away, after a while there was no contact so all seemed fine. I have had no official correspondence since late 2001. Payplan have contacted them and they're going to be included on the DMP.
Unfortunately the creditor is Barclays so I fear the worstDMP # 280

I hope not! - I am seeking a redetermination which will mean a meeting with me, creditor and the judge (i think) - explain how I can only afford the amount offered (and paid for the last 11 months) and the fact that there needs to be parity in what I am offering to the creditors.
I also imagine that if the court uphold the higher amount then this would become a priority debt - I don't really want this happening as I dont want my current payments to dip.
thirdly - I understand that I keep paying nationwide and the balance reduces as part of the DMP until the redetermination is made or not!
Hopefully the court will see sense as a change like this could have a dramatic impact on my DMP and my other creditors!:mad:

I will be seeking a redetermination from the court on the basis of fairness to my creditors and the income expenditure not allowing for such a significantly higher monthly payment.
any advice, links etc? - what can I expect will I/ should I have to attend court and present a "defence" of some sort?

Sorry, should also have said that CCCS advised that we should go along to the redetermination hearing so we could also put our case to the judge in person.

Halifax have been fine with me (the best out of many creditors, and I owe the most to them. Almost), they've passed over to DCAs, and no probs since. However... you'll discover that all creditors treat everyone in different ways...DMP mutual support thread No: 2430 -

OMG - if jasperconran can't cope with a recession, what hope is there for the rest of us???
I have no doings with Halifax myself but as ian so rightly says all creditors treat everyone differently. (But I just HATE those crass adverts!)
It all sounds a bit ' let's put the frighteners on' to me - could be you would be better off with a DCA.
I know it is extra tough coping when you have health problems - just take a deep breath and take it one step at a time.
And I so empathise - isn't a pain when it's costing you precious money to try and get an answer?
Sure it will all come right in the end.

Halifax were fine with me for 6 months and accepted my DMP without a problem, but then they became my worst creditor to date. They totally ignored every letter that I sent them via recorded delivery and they ignored all correspondance from CCCS. They added interest at nearly 10 times more than my monthly payment to them and they added late charges and over limit charges.
In the end I had to ask The FOS for advice and to cut this story short, Halifax refunded all of the interest and charges that they had added for the previous 6 months and they agreed to remove my contact numbers from their systems and to accept my DMP.
It was a long struggle but worth it in the end, my advice would be to carry on paying them via your DMP and get The FOS involved otherwise you will get nowhere with them.DMP mutual support thread member:3270 -

The switch from Kensington to Freshstart is going fairly well. Reliable Collections (my biggest problem) have accepted on most of my accounts so far, Studio accepted without a murmur and even NatPest have been quite nice :eek: Citi Cards rang the other day and started trying to get nasty saying I had to pay them fifty quid there and then or the arrangement would be cancelled permanently blah blah... I told them (of course) to bog off and speak to Freshstart. he did try again before I got him off the phone but I just reiterated I havent got £50 and thats why I'm paying Freshstart!
Other than that its not going too badly!! Hope everyone else is ok too.
