Hi... just thought i'd post an update on my dmp. It's been in place since Oct 2010 and I've been paying the agreed monthly payment to my creditors via the cccs ever since. Two of my creditors have taken action almost at the same time???? Banco Abbey, sorry, Santander who i owe just over a grand on an overdraft to) have issued a default notice and egg credit card who i owe a much bigger amount to (about ten grand) have phoned me and said they are going to issue a default notice (I advised the poor sod whose job it is to phone people and tell them this news that I do not recognise telephone calls received at the order of his employer as a reliable form of communication and to put this information in writing... no letter recieved yet).
I informed the cccs of the above info and was told this is entirely normal when on a dmp.
I wondered if anyone knows the ins and outs of what the point of a default notice is and what it actually means in reality? Big thanks in advance.
P.S. I still get junk mail offering credit cards in the post.. who knows what that's all about?!?!
You want them earlier rather than later - a default is just that, you have defaulted on your agreement and as such its now shown on your credit file. A default stays on your file for 6 years so the earlier you get them the better. DMPs are a "gentleman's agreement" so at any time the creditor make take different action - I have been on mine since Oct 2009, had 2 CCJs (nationwide) both contested in court to avoid a charging order and agree payments at my DMP rate - had various defaults but everything is now ticking over. Egg have just informed us that the debt has been passed to arrow (think they have passed a lot that way) so waiting for official letter before offering the continuation of DMP pmts.0 -
Hi all,
We have reached our 2 year anniversary since our DMP with CCCS started.
All interest was stopped by all creitors within 6 months. I haven't received a phone call from a creditor since then. I have (every 6 months) phoned each of them to check the account balances, which are all as they should be.
Budgeting was tough to start but after a couple of months it becomes the norm. Had to say "no" to a few things but not had to go without too much. Nothing I'll miss after a while anyway.
3 years left!! (Then I think we'll try reducing our mortgage!)
To anyone that is wrecked with money worries and is living on credit I urge them to contact CCCS and consider a DMP. It is life changing in the most positive way.[STRIKE]£67000[/STRIKE] in unsecured debt at LBM June 2009:eek:

Hello, I have a DMP question.
I set up my own DMP in 2006, and have paid of a substantial amount of my debt so far. From a 45k debt I now owe £200 to Egg which is with CapQuest, and about £7000 to Mint, who were the only creditor not to sell the debt on. They've frozen the interest and have actually been really good to deal with.
My question is - the default on my credit file - although it relates to the time that I defaulted in 2006, does it stay on the file for 6 years from then, or from 6 years from the date that the debt is settled? I've heard both, and would be really grateful if someone could clarify for me.
Thanks ever so,
AnnieSay what you mean.. mean what you say... without being mean.0 -
Hi All
Just a quick question - can you get a CCJ when on a DMP, or do they tend to only occur when someone refuses to pay a debt? Just having a moment of self doubt, that's all. I'm 2 years and a bit into DMP, have dropped DMP payment this month due to extra living costs but 3 year pay freeze (I work in the public sector), and just wondering if this was a likely course of action? I am, after all, not denying the debt but am continuing to pay towards it... DMP scheduled to end in 2017, although hoping to get a 2nd job soon so can increase payment again.
(I understand anyone who is owed money can apply for a CCJ, but as I'm paying my creditors a regular monthly amount through a well known company (CCCS) with an up to date budget/SOA, would it be worth any of my creditors going down the CCJ route? Surely a court would agree with the plan set up by CCCS? Or am I being blissfully naive?)
Thanks

I'm pretty sure it's 6 years from the date the debt is settled because even if you owe £10, if you are paying less than the minimum amount you are defaulting.
Hopefully one of DFW 'giants' such as RAS, Tixy, Ianmak etc will be along soon to clarify.LBM - March 2009, DMP Start - April 2009

It's from the date the default is issued (grantalien mentioned this in his last post).
CCJs can also be issued, again grantalien mentioned this happening to him!DMP mutual support thread No: 2430 -

blissfully naive is a bit harsh but...Yes they can go for a CCJ at any time (I would say more unlikely as time goes by) - Nationwide did me for balances of 2k and 3k and eventually the courts agreed that the DMP amount was fair, they also went for CO's on both balances but this was also rejected by court. I would say 9 from 10 the court will side with you as the payee if you have/can demonstrate you are doing all you can - It took Nationwide a year to take me to court! - its a lottery!0 -

But one where there's no chance of winning a £105,000,000 prize unfortunately!:(:(
The odds of getting a CCJ are also pretty rare, as you progress through your DMP and keep paying. (You though unhappily landed in the muck didn't you Grantalien - but survived to tell the tale thankfuly

Nationwide are the least understanding creditor ever. They have offered no help or advice, just one threatening letter after another. I think I will be going to court for CCJ in the next few months :mad:0 -

Indeed they are! I was told that its a lot to do with their status as a property buyer/lender - they seek to secure against property knowing full when they have the means to easily cash in if things went bad - In court the judge was very very critical of them and their practices, he sent them away with a flea in the ear and no costs! - I also found them very unwilling to work with me as I explained fully in court0
