  • Hi all, dmp started in December with cccs. Letter received from solicitors advising of impending legal action and advising immediate contact. I am sure that this question has been answered a million times before but,
    Do I need to advise CCCS of this letter, and do I need to advise SCM solicitors that I am on a dmp? I note that the address for the solicitors is the same address as ltsb collections centre, so am assuming that this is an inhouse dca.
    I am fighting the rising panic that is welling up, they can't have what I haven't got.

    I am starting a DMP any day now and have found Payplan really helpful, all my creditors seem to have been ok as well. I am just waiting for the sucker punch.

  • I've today had confirmation that Lloyds have accepted me for bank account. I get debit card but of course chose not to have overdraft! The very word makes me blanche!! I need to change bank as my current bank Nationwide are likely to offset CC (£2200) and £500 od.

    Anyway, the paperwork on it's way but the deadline for changing where salary paid is tomorrow. Payplan have sent me email with plan breakdown and are calling me on Sat. Am
    I best to ask them not to start action until after 21st of Jan when my wages go in? I can then ensure mortgage paid on 24th them whip the cash out quick?

    I had a chat to my mum tonight and she said she us aware cash is tight (understatement lol) and I could go to her for financial help whenever I need to as she loves me so much. I was nearly crying as I just can't tell her the extent of it. My parents are well off but that is because they are frugal and have saved all their lives... this particular gene obviously didn't pass onto me :p. They hate debt and have never been overdrawn! just can't tell them due to the shame and live in dread of losing my house. Payplan say this won't happen and my creditors are not ones to go for charging orders. I'm so scared though still.
    Second and final LBM 01/01/11 Nearly got there but fell of wagon. HAVE to do it this time :mad:

    hi guys

    quick question, our dmp officially started on the 1st January and our payment has gone out to CCCS. However, on new years eve we received a letter and halifax have passed my OH's account onto blair westcott and oliver is it? saying we will send people round your house, or apply for a ccj or take you to court blah blah blah. I am assuming this is a pretty standard letter??? Anyway I will pass this onto CCCS tommorow to make them aware, shall I also write to these people? I wouldnt mind but I believe that halifax were going to get the biggest payment anyway!!!!!! bloody creditors. On a brighter note Next have accepted already and I got confirmation in the post today:j

    If anyone could give me some advice on this DCA I would appreciate it. thanks

    Blair Oliver & Scott are quite nice people, so if you wanted to speak to them, they're not all bad. Have a chat to CCCS if you like and see what they suggest.

    Dont want to get too excited but so far, 4 out of the 9 creditors have accepted the dmp that CCCS have proposed:j

    Now got to keep my fingers crossed for the rest!
    LBM: April 2009 - honest debt figure: Secured: £0.00!! (paid back april 2017) unsecured: £53117.48 (roughly):eek: back with CCCS starting again:(

    Your situation is not unique. I'm not talking about the debts, we're all in that position here. I'm talking about you 'falling off the wagon'. I've done the same several times.
    Keeping strictly to a DMP is really tough, It gets really testing when you find you have a few quid to spare. To give up that money, or t save it for a rainy day is close to impossible for many. I think this is one of our biggest challenges, really.
    Perhaps there is a way your parents can help you, without asking them for money. First, open up and tell the truth about your debts..the whole truth !! I had to this to my OH and, the thought of it scared me rigid. But, once I'd got it off my chest things were fine, Painful, but fine.
    Perhaps you parents could meet with you every week, and go through your expenditure and income etc. That way, you won't be able to hide anything, and, they will help you manage your willpower..
    I did this with my OH..each week she sits with me and goes through everything and, it reduces the worry on her part too. Your parents will worry, and this might be a way of helping them... to help you ?

    Good luck. this is my new year resolution too. I've been on DMP for just over a year and all going well. But still found it very hard to budget and especially to squirrel money away for car stuff, Christmas etc.

    Going to try and walk and cycle to work as much as possible to save petrol (hasn't actually happened yet because of cold, rain - yes I really am a wimp or have no will-power!).

    Your idea of taking cash out for week sounds good. I use debit card too much and in my mind it's still 'free' (ha!) money like cc.

    Welcome to Steph. DMP was my life-saviour and really had no other choice. So pleased I took that first step of contacting first National Debt Helpline and then CCCS.
    Got nothing but praise for CCCS but I know Payplan has equally good reputation so its swings and roundabouts really
    Happy New Year to all DMPers.

    Panic, Alarm, sinking feeling and feeling sick some of the feelings i felt when i opened the mail today.

    HFC sent me what I think is a Default Notice, I have never received a letter like this from any other creditor. It states why the default notice has been issued and what I have to do to prevent further things happening such as court action it also states that the outstanding balance has to be paid by 19 Jan 2011 or they may take me to court alot of legal wording finished off by you need to seek legal advice do not ignore this letter. The letter also included a OFT leaflet stating DEFAULT NOTICE what to do. I panicked and thought this sound like they are going to take me to court. I have a letter from them agreeing reduced payments when I first started my DMP in June and they agreed an annual review.

    I have contacted CCCS who inform me that this letter is computer generated and a legal requirement and not to worry just file and forget but the letter is strongly worde. CCCS said they will contact HFC and send a review letter on Monday in relation to this default notice.

    Has anyone one else received a default notice and what did you do?

    Did it go to court ?

    Did you speak to the creditor direct? are let CCCS or payplan deal with it. They did not seem that worried, but i am at the thought of Court proceedings.

    I am a little worried I know the letter does contain a lot of mays, but i am worried when court action is threatened and I do not have the money to pay it also states that if it goes to court and they win then I will have costs to pay, more debt.

    Any advice much appreciated if only to ease the worry will they take me to court the debt is for £323

    Hi Mikon, don't worry these letters are quite common. I've had a couple and nothing has happened. They're just computer scare tactics.
