Well, looks like I spoke too soon
Interestingly enough I received an e-mail today from 'Kerry Mann'
I am sorry to inform you that Mario Kart: Double Dash has been deleted from
our supplier's catalogue.
This means that, unfortunately, due to a technical error, we are unable to
send the remaining item(s) from your order.
If you still require this order please re-order, omitting the deleted item.
I sincerely apologise for this inconvenience. If you have any further
queries, please do not hesitate to contact me.
Regards
Tesco.com
So, the item has been deleted yet it's still available for £37.99.
 Why do they bother lying? They would do so much better if they just admitted it was a frickin price mistake. What is this 'technical error' that they're talking about??

How disappointing. You seem to make a habit of not being able to obtain all
things Gamecube! Can you please keep my order open (at the price quoted
below) until you have some more in stock. The game seems to be in plentiful
supply elsewhere, so I'm sure it won't be long before you re able to get
more in.
Regards
I got the following reply today:Quote:
Thank you for your email.

Please accept my apologies for any inconvenience caused

Isn't email tennis fun with these CS people!!!
"Hi
If this is customer services why have you copied an earlier reply and pasted it into this latest reply (see thread below), not very helpful. If you can not fulfill the order as stated from the original date within the 30 days I will be obliged to pass these details to the Advertising Standards Agency. If you know its policies then you you will be aware that you cant say we did not have enough stock as you should anticipate the demand as the major retailer in the UK. I quote from there CAP code " 30.1 Promoters should be able to demonstrate that they have made a reasonable estimate of likely response and that they were capable of meeting that response.
30.2
Phrases such as "subject to availability" do not relieve promoters of the obligation to take all reasonable steps to avoid disappointing participants.
30.4
If promoters are unable to supply demand for a promotional offer because of an unexpectedly high response or some other unanticipated factor outside their control, they should offer refunds or substitute products in accordance with clause 42.5a." http://www.asa.org.uk/asa/
This was the biggest selling game in 2004 and is still widely available now!"
Hmm, wonder if I'll get the same response a third time?!?!?!Cheers
Jon
If you appreciate my post I really appreciate a Thankyou0 -
Unfortunately ASA have no jurisdiction over website offers...only hard copy 'catalogue/flyer' type offers.
I have a letter from the ASA with regard to another website matter that states exactly that.Herman - MP for all!
