    Ok as noted, if they arent governed by UK law then the question is moot.

    However, if (for argument sake) they were in the UK, nothing in a legal contract can remove your rights from what i know.

    I once worked for Thomas Cook who had it in the employment contract that they could change your working hours on a "needs of the business" basis.

    When they tried to change our working hours, i fought it on the basis that any changes to our contract basics (rate of pay, hours or work, type of work etc) had to be approved by the employee and to force them on the employee was a breach of contract and against our rights. At first they were concrete they were right, because it said they could in our contracts. I gave them the information from a goverment website and told them that UK law overrides their contract.

    Long story shorter, they contacted their legal team in peterborough who told them i was correct and they couldnt force people to accept the changes, they could only offer incentives to "persuade" us. They came back and told me this..............then asked me not to tell anyone else...........i told them they were too late :D

    I remember people saying "they're thomas cook, they wouldnt do anything against the law".................well i know from experience they do and i would never book a holiday with them over the phone due to their lax "security" with customers details (including credit card details, DOB, passport numbers, CV2's etc).

    They are not removing any rights. They have just clarified what your rights are in words that most people, who have not looked at DSR and 'know their rights' from snippets picked up, understand

    Just merely stating that they can have anything in their T&C's......but if it contradicts what your rights are as a consumer, basically it doesnt count.

    You'd be suprised how many people think that they can get away with unlawful practices just because a contract was signed.

    While i understand that not all countries offer consumers the same level of protection the UK does, i find a lot of retailers dont make it clear they're in a different country or sometimes even give misleading information/subtle hints to make it seem like they are in the UK when they're not.
