when does my son stop being a child?confused

    There is no way on gods earth that you can predict a DLA award from a few sentances on a forum, DLA is awarded for care or mobility needs only and not for diagnosis, you cant look up the criteria and make yourself fit it, thats fraud.

    I think that your son may have made a mistake or not been entirely truthful. Nobody would tell him that DLA didn't exist anymore or that he could claim ESA as a full time student.

    what i wrote about critria is corrct you can do a serch on dwp site and condition the information and the care and moblity needs for each condition, i wouldnt ever say do this and you will defo get this dla is very messy and a hard from to fill in and i cant do this myslef dysleica etc i was just showing what the decion maker uses to make a descion about the condition itself

    why i said about the level of mob was poter stated that he struggles walking thats part of cretria and i suffer from a simalr condtion myself x

    i was sat next to him and he had the phone on speaker phone.i didnt want him jeopardising my claim.he told the truth.income support have told me on the phone today if i hadnt rang them it wouldnt have been picked up and could of gone on for ages.he gave my NI number,child benefit ref,date of birth.we live at same address.dwp have admitted they gave wrong info.person on phone got it wrong.the dla thing was my mistake,its incapacity doesnt exist anymore.he told them how many hours he was studying and that he wasnt getting ema due to absense all the time and they gave him esa.he wouldnt lie over something so important,not all teenagers are the same.he has been brought up to be decent and honest.

    i get dla care and mobility myself,i know its really complicated.always filled my own forms in and had no problem.i think it depends on docs report myself,i was only on lower mobility and my consultant told me i should up it as i could hardly walk and there were days i couldnt even get dressed[rheumatoid arthritis].react to all meds i tried,got nurses out every day dressing huge blisters on my legs after the last lot!waiting to try sumat else.nightmare.

    thankis for all the info everyone.its nice to know everybody is here to help;,hope i can help somebody myself soon!got it all sorted now much to my relief.son wont have to pay esa back until hes working but dwp say he can appeal as it was mis information on their part.and i get all benefits back til son !!!!!!s off to uni in sept.phew!had visions of having to sell my body to make ends meet.cant give it away at min.prob get more if i weighed it in for dog meat eh?!lol. again,thanks sooo much for help xxxx

    The lower and higher rates of the mobility componant have very diffrent criteria, for lower rate its mostly about someone needing supervision outside where as the higher rate is given to people unable to walk or virtually unable to walk.

    Your son should apply for DLA if he feels he may get it, you dont need help with the forms as you (and I ) have found.

    I hope you both get everything sorted out quickly.

    i agree with you sunnyone.if you are genuinely in need of the benefit you have no problem getting it,i am always 100% honest and have gone from lower rate to higher rate mob and lower to middle care.as far as my son getting it i dont think he would as there is no test or proof for ME.he looks fit and healthy but after a day at college he spends two in bed.he had an exam this morning and got a lift home from his tutor he was so done in and went to bed,hes still asleep now.breaks my heart to see him like this.wish there was a cure.is there a medical forum on here? maybe somebody will have coping strategy for him.

    This was why I said it could be a mistake and I can see how it has arisen. If he's told them only the number of hours he has classes and not specifically mentioned that it's a full time course, they may well have classified him as a part time student which, I think, would allow him to claim ESA.
