when does my son stop being a child?confused

am new so be nice:o.my son is 19 and just finished a third year at college.he has ME so didnt feel up to uni.he is now going to uni in my hometown but living in.i am on higher rate mobility £49.85 and care component of £47.80 which is middle i think.i received a letter saying i will not receive income support for my son and i will also lose disability premium as there will be another adult in the house.will they re instate the disability premium when he leaves for uni and will they stop it every time he is on holiday and back staying here?am ringing tomorrow to try and sort it.i was told if my son went to college again he would be classed as a child until he was 20 and my benefits would stay the same.i dont expect to get is for him as he is moving out but he is classed as a student til 30th june according to college and has exams til then yet is for him has been stopped.i will be getting it for myself.am not a scrounger,worked all my life until i was attacked and left for dead,the shock brought on rheumatoid arthritis which is horrendous.i cant take the meds as i have allergic reactions to everything.trying to find summat i can take.consultant told me to apply for all benefits.wish i could go back to work:(

    Once your son goes to Uni, he is no longer a dependent.
  • child benefit wont end till the last monday in August,so if you still get I/S for him that will continue till then(although most people get ctc not i/s for kids now)
    if you are claiming SDP then that will stop at the end of august but start again once he leaves home for uni in late sept.,it should continue if he has a permanent address whilst at uni,even during the long summer vacation providing he has as i say a permanent address at uni(if he doesnt then sdp will stop then start again).
    Its a really complex issue and when we had this problem i had to get legal advice from CLS and get them to write to the benefits office to put them right.
    It all comes down to the address issue be it halls or rented accomadation,but he can spend time with you and be classed as a visitor not a resident at your home in the christmas and easter holidays for example.

    Does your son recieve DLA?

    he has just started getting esa as he wasnt ever in college long enough to get his ema.he has to live on something!!

    thanks anxious mum,i know that.cant wait!lol. its just the question of my disability premium.as he is here they have stopped it.last yr they contacted me and asked me what he was doing concerning education/work etc and i told them but they have just assumed this year.they have stopped paying me for him and my premium.you dont get it if there is another adult in the house.doesnt matter that some days he cant stand up when he is having a flare up,god knows how he is supposed to look after me/ wish i could get on with life,work and be answerable to nobody except myself,oh and my mum who terrifies me even tho am 44.lol

    because until they are 21(or is it 25?)for student loan/grant purposes they are still classed as dependant,unless they are estranged from the family.

    if you are losing you sdp while he is still at home, could he claim carers if hes helping you?

    he has ME himself so i dont really see how he could be expected to care for me?thats what i dont get,he has health problems aswell so i dont see why i should lose sdp?he'll be at uni sept anyway.going to ring in morning and sort it,sunnyone told me what i already thought,its just that with no warning i got letter stopping all payment as of 3rd june.hes still classed as a student at college til 30th so i dont get it.i've still got same bills to pay and they have taken over hundred puond a week off me without warning.i just want my premium back,i wont get money for son much longer anyway so not an issue really.thanks for suggestion anyway.if he was staying at home we would have to consider it though.such a tangled web this benefit system.they dont tell you what you are entitled to unless you know yourself beforehand.i asked if son could get dla as ema stopped due to poor attendance,they said no.asked somebody else next day and they filled form in over phone and he gets 50 something esa now,not means tested,doesnt affect my payments.nobody told us he could apply though.

    If your son is no longer a student and is receiving ESA he should be contributing most of this for his share of food and household bills. If he's claiming benefits on his own behalf, this will be why you've lost CB and CTC for him.
