That really is terrible advice you have given your mother, and you are going to cause her more stress and expense.

Your mother is entitled to a remedy (repair/replacement or refund) but due to the length of time she has already had it, she cannot demand a remedy that is more costly than the other options (i.e. the retailer is within their rights to choose the cheapest option.)

So rather than your mother having a washing machine that could be working on Tuesday, you have advised her to refuse the repair and to spend months waiting through the courts. When you get to court, as Comet have acted within the law, you are likely to lose and therefore have incurred more costs.

Hear what you are saying - and agree. However, suing Comet will cause them to settle straight away. Or at least in my experience.....

Also it wasn't really "faulty from new" given that it worked fine for four months

Some people on this forum really do steep to low levels. I can easily understand why all this extra hassle cannot help, an already very fragile situation for her Mum. It really annoys me when there is no compassion out there.

I had a problem with Comet, over 15 years ago. They had the worst customer services out of all the companies I dealt with. My problem related to a HP agreement with 12 months free interest. If I paid before the 12 months were up then I wouldn't be charged. I sent a cheque the week before, and guess what it was 'lost'. They then wanted a ful 12 months interest, and insisted I paid monthly for another 4 years for my product. If I paid earlier, I would be hit with penalties. I wrote to the Managing Director, with no success.

Since then I have not even walked in their store. They have missed out on a household, which has spent upwards of 20k (the average household I guess) on hoovers, dishwashers, computers etc etc. I wouldn't touch them with a barge poll.

The lady shouldn't even have to mentioned her Mum's problems. They should be apologising profusely for selling a 'dodgy' machine, and breaking down doors to get her a full working one, without any kind of delay.

    Good Luck OP.

No I didn't take the credit out with GE capital or Santander. Please get your facts right before making stupid comments.

I took the finance out with Comet, who in turn brokered the loan with a 3rd party. I sent the payment off to the 3rd party in good time. The cheque was lost and this was realised within a fortnight. If Comet had wished they could have intervened but didn't want to know. The customer service was non existent.

Well, we emailed Comet and they replied.

Basically, they said sorry - but we'd have to wait for a repair.

They refused to cover any costs.

They are now due to perform a repair on June 15th. Ive told Mother to write clearly on their paperwork "repair not accepted - machine faulty from new" and refuse to sign it.

Unless Comet replace the machine, I will be taking them to Court on behalf of my mother.

How is refusing a repair and starting a court case going to help your mother cope on top of a serious illness in the family, as you were mentioning earlier?

Comet have behaved very unsympathetically, and regardless of the legal position that's poor customer service, so if you didn't want to give them your business ever again I for one wouldn't blame you.

But with the greatest of respect I think you need to ask yourself: Am I trying to help my parents or am I trying to prove I was right?

    Hi,

So you took a credit agreement with a 3rd party (as you state above), failed to pay it in time .... therefore (as per their t&cs) you were forced to pay far more - how exactly is that Comets fault?

Wow Mark, this is hard work sometimes. I took a credit agreement out with Comet acting as a broker. They obviously got paid commission. The agreement was that if you paid the payment at the 12 month stage, you were not charged any interest. Is this clear so far?

I paid within 12 months and the 'associate company' denied receiving the cheque. Interest was back dated for 12 months and I could not pay it in full, without a huge redemption figure. Within days of realising that the cheque had 'gone astray' I contacted the credit company and they said that the time had now past. I then contacted Comet to ask if they could intervene, and they were not interested at all.

My argument was based on the fact that Comet did not care about the customer. They had sold their product. Received their commission, and plainly couldn't give a ****. Hence for this reason I have not dealt with them again.

They had no duty under law to become involved. But it would have been nice to see they valued my custom.

Anyway that was all many years ago now. There are a lot of retailers out there to chose from both on the net and in the high street. If I choose not to use them, then that is upto me.Reading some of the other horror stories about Comet on here, simply does not surprise me!!

And if they don't and call her bluff, she's facing a pretty hefty legal bill (as well as no new fridge)
