Need ADVICE pls - New Phone replaced by BMP.net with a used one
I have purchased a phone from buymobilephones.net about two weeks ago which had a problem with its camera. I had to post the phone back to them last Tuesday and was promised a new replacement.
Today, I received the replacement phone and noticed clear scratches on the front cover and also on the back. The lens cover and the area surrounding it is also darkish due to the extensive use it had (or probably because somebody tried to remove the lens cover ??) I am very angry and disappointed at buymobilephones.net.
I would like to get your opinions on what I should do next ? I am afraid they may continue sending me used replacements again several times if I return the phone. After the 13th, 28 days will be passed and I will have to take whatever phone I have by then to Nokia for repair.

The company replied today saying that the phone LCD does not have any scratches and that there is nothing wrong with the phone. They said they would send it back to me !!!

Have you taken the plastic screen cover of it? Top left hand corner of that pic suggests the plastic is still on the screen.0

Did you pay with a credit card ?
If you did and they cover the amount you paid, refuse the phone ( making sure it is signed has rejected ) and then approach your credit card with a view to them making a charge back against the company.0 -

They claim that the scratches are only on the plastic screen cover and that the LCD is intact. However, this still doesn't explain the appearance of the area surrounding the camera lens on the back. Also, a brand new phone should not have these. Well, at least the first phone I received from them did not.
They responded saying that they will send the same phone back to me without explanation to the cause of cosmetic defects on a supposedly brand new phone ! The scheduled delivery is on Monday.
I am thinking of simply rejecting the phone.0 -
Did you pay with a credit card ?
If you did and they cover the amount you paid, refuse the phone ( making sure it is signed has rejected ) and then approach your credit card with a view to them making a charge back against the company.
I paid with a Visa debit card. The phone is still with them and they said they posted it and I should have it on Monday. I will be refusing the delivery, but I still have the T-Mobile SIM card. Should I send it back to them or to T-Mobile ? It's a 24 month contract and T-Mobile should start charging me for the first month next Monday. Should I cancel the direct debit ? or notify T-Mobile first ?0 -

I thought you bought a PAYG phone. I didn't realise a contract was involved. You have 7 days cooling off to cancel the contract, but 28 days to have a new replacement phone ( which you have already requested ). You can stand your ground and demand a new phone on the grounds that you feel they sent you a ' less then new example', but that wont effect or cancel your contract.
Someone else will be along shortly to advise.0 -

This is their last reply:
"I have inspected the phone again and compared it to the photos. All of these are on temporary plastic covers as I mentioned earlier. To confirm this I have had to remove them so they are no longer on the phone. I have replaced them with protective tape designed for this purpose so the fascias do not get damaged in transit."
Well, they never answered my two concerns:
- What has caused these scratches on the front cover ?? Even if they are only on the protective cover as they claim, the phone is supposedly brand new and should never have any scratches.
- What about those on the back of the phone ? As can be viewed from the pictures, they are on the plastic part surrounding the lens and there is no plastic cover on that side of the phone. And again, why would a brand new phone have these cosmetic defects ?
Well, I am not sure what my next should be If I chose to refuse the delivery of the phone... I would never have agreed to the contract if it weren't for the phone.. and I was expecting a brand new phone when I placed the order.
Again, any advice would be very much appreciated.0 -
