I think like most consumer rights situations, we are going to have to agree to disagree. Unless this ever went to court, it would not be able to know what the outcome would be. As far as i am aware, there has never been a case of this sort go to court.
Agree on all counts. The analogy above is different again, as it has nothing to do with breach of contract (or whether it was a breach of contract in the first place).
...I know we're pretty much done here but I can't let that go
it has everything to do with breach of contract. Providing the sign is placed such that everyone who enters sees it, it forms part of the contract between customer and shop owner. Like car park signs.I really would like you to be right, but i think that it would be irresponsible to advise anybody to take BT to court (particularly if they are short of money anyway). As the OFT proved with bank charges, it is very difficult to prove unfair contract terms, and that was when it appeared to be clear cut.
As i said from the start, if i was the customer, i would contact BT and be very nice and see what they say.
Of course it would be irresponsible to advise anyone to go to court in this instance, I'm pretty sure I never did such a thing! You saw my posts advocating Otelo, it _literally_ costs nothing besides postage and a bit of time (other than risking losing a gesture of goodwill)
In order for consumers to fight back against companies, we need to establish our rights, not necessarily because we will take action but because one day we might have to. Since lawyers aren't free, the best way to do this is to collaborate together to try to form legal opinions. You talk like this discussion was pointless, but even if I'm wrong about the conclusions I'm drawing, there will probably be some people who previously hadn't heard of legislation like the UTCCR or the OFT guidance who may find it helpful in the future. They will now have some of the groundwork to conclude their own conclusions on the law, that they won't have been able to find using Google without that groundwork.
Or I'm being too optimistic and everyone's lazy

Not at all, i like a healthy debate.
In all fairness, if BT give a negative response to the OP, then quoting what you have posted may make them change their mind. I am just not convinced that a court would agree with it.
Maybe i'm too pessimistic.0 -
Ok more sucess dropped to 100 quid,
Couldnt of done it if it wasnt an english call centre, not being racist or anything but i think it is impossible for them to deal with such large amounts in different offices. This is the one to call : 0114 2020289
I made the point offer and offer again that if had been informed after the first month we would have changed onto unlimited:
break down of the months and fees:
Feb £103
March £233
April £165
They have let me off with only paying the first bill.... They have back dated our unlimited broadband back to March. It is BT policy not to charge you for the previous month if you are not over the second. So maybe i will try and get the 103 quid back as well. He also lied to me several times telling me that unlimited internet means unlimited, which we all know it doesnt, wish I was doing this through skype and I could of recorded him lying.,.... anyone else with problems feel free to contact me.
PS when they say right ive gotta clear it with the manager all they do is put you back on hold, dont be scared to push once they have offered you a reduction they cannot go back on it anyway ,,,,
Didnt really need to spend my birthday doing that though!
Happy Birthday.
You just got a £366 birthday present, that's not bad.0 -
