I bought an MP3 player on eBay and, as requested, put the colour I wanted in the notes in both my message to the buyer and in my payment by NoChex.
Of course, the prats ignored this and sent the default colour. I checked that I could return it and exchange for the correct colour, and did so, at my own expense by 1st class recorded.
Royal Mail say that it was delivered the following day - the online checker shows a proof of delivery which appears to be stamped with "EPOD CHECKED" but with no signature.
The vendor claims they have not received it and advise me to make a claim on Royal Mail. But if Royal Mail say they have proof that they have delivered it, won't they just come back to me and say they can't do any more about it?
Where will that leave me? Help!

No-one seems interested in my dilemma
so I'll just add that I have put a claim in to Royal Mail.
However, if they say they have proof that it was delivered then I doubt I will get very far.
But this raises the point that what is the advantage to me of sending by Recorded mail? If I had sent it ordinary post and the recipient claimed it hadn't been received, then Royal Mail would have no proof of delivery and they would probably pay out without too much fuss.

Put a claim into paypal on the basis that you have returned goods and haven't had a refund. I think you missed the bit that I returned the item to the seller, so as I posted the item back to the seller so surely the contract is between me and Royal Mail?
As the seller sent the (wrong) item originally, would having paid by Paypal have helped anyway?

Oh, I also missed the bit about nochex (I just assumed it would be paypal), in that case I can't see what the OP can do at all.
The only option is no neg the seller to warn others, but expect a neg in return.

I was in a hurry (hah!) to get the item as a present and wanted to pay by credit card.
I was a bit confused by the Paypal enhanced payment business on credit cards and having to wait for a reference number, so went the Nochex route - obviously a mistake :mad:
If Royal Mail come back and say they definitely delivered it would there be any mileage in raising a dispute with eBay?

I would file an ebay dispute on the basis that you havent recived your goods.
When sellers have thousands of feedback one neg wont really have an effect.
I would stick to your guns and go through Ebay, email the seller and state you have proof the goods were returned and request a refund.:beer:0 -

You can't do a claim against the Royal mail as it shows as delivered, so there is nothing that can be achieved by going back down that route,
Making a complaint to ebay isn't going to get your money back, nor will the seller be penalised as ebay don't usually get involved in disputes like this but it may give you some satisfaction to raise a complaint and possibly get a mark on the sellers account that indicates that there was a problem.
However, this is really a tricky one as the only way to get money back would be to make a fraudulent claim somewhere, and that would make you as bad as the seller. Either making an item not received complaint via ebay would be fraudulent, as would making a claim against your credit card. I suppose there could be an argument that as you did not receive a replacement then your credit card might be liable, but it is probably going to be a difficult one.
