    go to your bank and cancel any direct debits with paypal


    paypal WILL get nasty with you on this one, they'll call in debt collectors and tarnish your credit score, BUT, stick your ground. i've not heared of one genuine case where debt collectors have actually obtained goods.

    also, contact the FSA (financial services) and inform them of your case. seek legal advice also (small claims maybe??)

    at the end of the day, your paypal account is negative, not your bank, so, tachnically, you're not out of pocket yet!

    if the money went into your bank, then back out, tell your bank that it was a non-authorised transaction, they will have to 'reverse' the reversal!

    Your only course of action now to get the money back is to make a claim in the small claims court. You need to try and establish if the name of the person you sent it to is genuine or not. You might like to report it to the police and there is an outside possibility it would be covered by your insurance if you have it.

    Hi JD and all,

    My wife works for one of the big credit card companies in the disputes department, and she deals with this type of thing daily. She tells me that if a card holder reports unauthorised use of a credit card, and due to the size of the transaction, this would be referred to the fraud department. You said that you had proof of delivery. If PayPal are not willing to dispute the transaction especially with proof of delivery, I would go to the police and get the police to liaise with the credit card company.
    Basically someone has been stealing here, either from you, the guy who bought the item, or both of you.

    Would Dan29 or someone else be prepared to check this guys address details if I private messaged them? I did look on B4u search but couldn't find him.

    Maybe I'm being pessimistic but would the police really care about this?

    And would this really stand up in the small claims court? After all he must have had a believable enough reason for his credit card company to claim the money back. Wouldn't I then also have to pay court costs if I lost (though I'm on benefits so would I be entitled to legal aid of some sort?)

    Apologies for all the questions but I've no experience of all this and am struggling to get straight in my head what to do and how to go about :undecided

    Yes of course. Unfortunately I don't have access to 192.com any more but I'll do what I can and if I can't come up with anything, there are other people on here who can help.

    ultimatley, the fsa may not directly help the op,

    the more complaints received however............this one may well be the straw that broke the camels back!
