It has nothing to do with mandi trying to be controlling. Its about their neighbour not being polite enough to ask if she actually minded him moving the fence to where she'd get less privacy.
Maybe if he'd had the decency to ask her first she might have reacted differently.
But as has been said if you complain the i'm pretty sure he'll have to move it back

Maybe he did have a "small" fence around the area for the last 12 years and has now claimed the land as his own which is perfectly legal. If the land was very overgrown you may not have seen his fence.

Maybe you are upset you didnt think of it first ?

    thats my point
You're not drunk if you can lie on the floor without holding on
  • Why not put up your own fence inside his (on the boundary of his and the unowned/claimed land) - then you can have the land(in twelve years time).

he cant complain -its not his land

i dont know but i would assume if it were you who fenced off the land and maintained it, with no objection for 12 years then at the end it would belong to you rather than being part of the property that you rent at the momoent and owned by your landlord

    calm down mandi

The point of this thread was to ask what can be done about him putting up a fence on land thats doesnt belong to him

    Thanks

No you don't have less right to privacy, but as a tenant you are in a weaker position to do anything about it in this instance. You say earlier in the thread that the gardener mentioned that you rent your property, so the other owner will be aware that you don't own the property.

It was selfish and rude of him to do what he did but I can't see that you are in a position to do anything about it. Have you tried explaining to him about your loss of privacy? Ask him whether he would put up a higher fence or replant some tall bushes. After all, it is not just your privacy that is affected, his is too.

This story reminds me of a couple we used to be friendly with who had a similar strip of land at the bottom of their garden. Using the adverse possession rule, they built something on the land and some of their neighbours put up sheds. They wrongly believed that by putting a structure on it, the land could not be reclaimed. Further down the line, but within the 12 year period, the owner comes along and announces he wants the land to turn into an accessway to a property he is building along the road. They all tried to object, but could do nothing about it except remove their structures in the deadline he set. He did at least agree not to charge them rent their use of the land.

some how i doubt that lol, yes you pay rent, but as you dont hold the deeds or the one with the mortgage i cannott see AT ALL where you as a tenant is allowed to deal with things that ARE to do with your landlord,it is not effecting your tenancy, just that its put your nose out of joint, by all means put it too your landlord, but its for him to deal with if hes really intrested
