How bad is this?

Just before exchange, my solicitor realises that original deeds floorplan of flat I am buying differs greatly from present day floorplan. A kitchen converted to a bedroom and a btahroom added etc

No planning permission found..is this a dealbreaker?

    Shame he found the original floorplan! How many people have their original floorplan?

    Normally you don't need planning permission for changes to the internal layout. You do however need to have complied with building regulations. Provided that the regulations at the time were complied with there should be a certificate to pass this. (Anyone who keeps original floorplans. will presumably hold onto certificates).

    If there is no building regs cert, then the seller may have to get the place inspected to see if it meets current regs. This would cover things like removing fireplaces, supporting walls etc. The middle way is for the seller to take out an indemnity policy covering you for the fact that no certificate is available.

    If your surveyor has not found serious faults its not a deal breaker.

    We recently sold and though I had the letter from the council giving planning permission for the extension the previous owners had built and the building regs certificate passing the work, I had no plans. Who knows what the PP and certificate actually related to?

    You don't normally need planning permission to make internal alterations. Some of the alterations might have needed building control - maybe not, depending on when they were done. Today's building controls do not apply to alterations made in the past.

    What has your solicitor advised?

    My solicitor has advised "think carefully before you buy this flat" and has written to vendors solicitors. He has checked and says no permission to move kitchen, add bathroom or change a 1 bed to a 2 bed flat. He doesn't seem very happy

    I would ask the Seller's Sols to provide indemnity insurance - as long as you are happy that the survey has highlighted no problems.

    Are you sure? Does that mean that up & down the current old alterations may have to be re-done to comply with current regs?

    Nothing has to be re-done if its over 4 years old.

    If you've done something that comes under regulation eg removing a chimney stack, it should have been checked. If it wasn't I would certainly get my surveyor to check it was safe!

    Is it a leasehold flat? The floorplan would be included with the lease, and you would need freeholder permission regardless of building regs, etc.
    When I had my loft converted back into a loft, the neighbours came around and scoffed, and called me retro.
