The Box had been opened.

I purchased a TV from my local Aldi shop yesterday. When I finished work last night, I began to assemble the TV, and fond the following:
1) The box had no sellotape circles on the two openings.
2) The television poythene had just been wrapped around it, with yet again, no sellotape.
3) The remote control already had the batteries inserted, and the polyethene cover for the batteries was inside the envelope with Instruction Manual.
4) The Television had already been used, as it had been tuned in.
Where do I stand here as I am pretty sure if the checkout girl, who went through the back to retrieve the TV, when there was a box displayed on the checkout line, should have told me that this TV was second hand, or at least Box Opened Goods.
I paid the full avertised price.
Thank you for reading my gripe.

I believe they have a 30 day refund policy but If it works I fail to see your problem"The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts."

Of course it works. That is not the point I am making. A 7 year old TV could very well work.
My point was that they did not inform me that it was obviously a returned item to them and they sold it on to me as a new item in the box.0 -

No shop tells you if the item has been returned by a previous customer!
Do you live a very sheltered life?!I was born too late, into a world that doesn't care

It could have been a display model.
Lots of items like this are returned for various reasons. They are not necessarily refurbs or second hand.
If it works and you still hve the receipt etc then your consumer rights and warranty etc are not affected if it breaks down."One day I realised that when you are lying in your grave, it's no good saying, "I was too shy, too frightened."
Because by then you've blown your chances. That's it."0 -

No you are right when you say that. Though they could have made a better effort in concealing the fact it was not Brand New in the box.
Where does your sheltered life exist. Because mine does not allow me to take returned goods or ex-dislays for the full listed price. "Compensation" being the keyword.0 -
I would ring the store and ask to speak to the manager. Tell him/her that you are dissappointed that the goods appear to have been used before (returned or ex-display).
Say you would like an exchange and see if they offer a discount - provided you are happy with the goods, would save you lugging it back.
Although the TV works okay, you never know if it was returned due to an internitent fault? Sure, it will be covered by waranty but then you have to go through the hassle of repairs etc.
Good luck.0 -
Could it have been a demo then?
If you are unhappy with it, or their principles in not telling you, then return it and make sure they know how you feel.0 -
good luck proving it. i suspect they'll just say it was you who opened it/tuned it in, and then challenge you to prove otherwise. the moral? if it bothers you that much then check purchases before leaving the store.GREENS M'SHIP OFFER NOW CLOSED SO PLEASE DON'T ASK ME!Olympic Debt-free Challenge £2150/£11900 = 18.0%NOW INVESTIGATING AN ALTERNATIVE TO MY IVA - I WOULDN'T RECOMMEND ONE ANY MORE!0

Don't know if this will be available for yours but i found a code on www.avforums.com for my Panasonic plasma which calls up the service screen which in turn shows how long the TV has been turned on for. I think it also shows the number of times it has been switched on. It would at least help you establish if it has actually been used or just maybe unpacked fo some reason.0
