  • No surpise to me that Vodafone can behave in this way.

    Recently they have caused me to lose a mortgage for a house I desperately needed under the Government HomeBuy Scheme. They were quire happy to have my account whilst the sun shone and I was spending vast amounts (some months over £300) with them. Then the credit crunch hit, self-employed partner had little work and I have to try and pay all the bills and survive on very little. Up to this point, reasonable credit - no reason to suspect I wouldn't get a mortgage. Then have to tell Voda that I disupte a particularly large invoice as seemed to be charging me for being on phone at say 11.15 and then further call at 11.15 etc., and later that can't pay at the moment. Lo and behold, despite a payment on 1st August of circa £150 and then £10 in September (all I could manage), they cut me off and then cancel and, unbeknown to me, Default in Nov. Have tried and tried to reason with them to no avail. Voda "backoffice" led me to believe they would remove Default and replace with a "one late payment marker" but thuis failed to materialise and then someone in C/S says I had "misunderstood" their emails. Suddenly Default is deleted from my record on Equifax. Then, lo and behold, turns up again with different data saying late payments in July, Aug, Sept, Defaulted Oct and satisfied in Nov. They know they've messed up but continue to ruin my life completely. Kept the Reports thankfully and am now pursuing this but too little too late. Had I had a Default notice I would have begged the money from elsewhere. 7 months pregnant and feel like life's not worth it. Sorry for the rant.

    Under contractual law to apply a default they still need to send a default notice, as they have already amended the default notice it is clear they are unsure when the default should have been applied and you should challenge this via the ICO.

    The strategy relies on the fact that a Default warning letter was never sent out.
    The law states that before a default can be issued the lender has to send a default warning letter.

    Contractual law does appl yo service agreements, which are what mobiles are.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    In what way?

    Vodafone have always had a fair use policy, and always said if you over use it they reserve the right to charge or restrict your use.

    The've just clarified what they will do, not change the policy.

    Just a thought. Arguing that 500mb is not enough for a smart phone is really not relevent to this change (despite how you may feel). This is about a change from 500MB fair use with no known charge or sanctions for exceeding it (that anyone knows anyway) , to a system where you are charged if you exceed 500mb/1gb/1500mb and so on.

    It may or may not be, (I dn't think I went over it) but thats not the issue here, trying to drag it in will just muddy the water.

    Similarly the iPhone and Nexus One are premium devices and have there own tarrifs,again it's not relevent to this discussion.
  • I had actually already sent details to the ICO before they changed the data. So glad I saved the Credit Report Files and am about to update the complaint with them and OTELLO (Voda's ADR). Have looked at this site before and not posted but so fed-up after latest mortgage rejection i posted. Was sort of hoping that the Web Forum guys might step in and try and help me out but I think they've had enough today!

    Thank you! Finally a voice of reason. This is what I've been trying to get through to the people on the other thread but obviously they are hell bent on finding a flaw in the T&C's to get out of contract. There has been no breach of the terms that I can see. They said they will charge if you exceed and its clear as day in their T&C's. The fact that the charge is now £0 to £5 when exceeding is irrelevant. But they will have mechanisms in place to notify users when they are close to their limit, so they will have the option to monitor their usage or increase their allowance as necessary. This can only benefit the owner.

    Its a simple case of take on the contract if it meets your needs, if 500MB isn't enough, move on and find something else. Don't go complaining about it after the fact!

    The issue lies with people such as myself, who renewed over the phone to an "Unlimited Internet And E-Mail" Plan.

    NOWHERE in the e-mail I recieved after renewing does it mention 500MB. NOWHERE.

    The only reference to the Mobile Internet is as below:
    Mobile internet and data usage
    We will charge you for any data you access outside your monthly allowance at the published rates for your price plan. We charge data use by kilobyte (Kb) at our published rates in 1Kb steps. We round up the charge to the next whole penny at the end of each use. If our content control prevents you from looking at any mobile internet content, you will still have to pay a data charge at your normal price-plan rate for any data used in your attempt to see the content. If you are on an unrestricted data price plan or you have an unrestricted data bundle, you can use the mobile internet for:
    a
    b
    c
    calls over the internet;
    legally sharing data files over the internet; and
    giving other people access to your mobile equipment over the internet.
    If you are on a restricted price plan without an unrestricted data bundle, we will:
    ·
    block access to these services;
    ·
    restrict network performance or
    ·
    charge you for this use at the full published rates as set out at vodafone.co.uk.
    If you want to use your mobile phone as a modem, you will need to be on one of our price plans or using a data bundle which specifically allows this.
