Buyer says not as described, what to do

    Is this a plastic or wooden house?
    Were your pics of the house built? If so surely any bowing of the walls would have been noticable on the listing.
    Also didn't you say that they have left feedback for others complaining about silly things?
    Might be worth mentioning that to ebay, they are probably serial moaners who hope to get partial refunds on most purchases, as then they've got a real bargain, by seeing someone else off.

    Latest message from buyer- (this seems to be because I asked for the photos she claimed she had)
    hi, can you please also email me your evidence that i did receive a great and clean condition play house (pictures of the playhouse after you cleaned it) as at present it is most unfair that you think it is acceptable for you to keep blatantly calling me a liar and yet your auction pictures clearly show that the item was NOT clean and was VERY dirty, as such can you also provide evidence to prove that i am not being truthful and that the playhouse was cleaned before sale, as i am not tolerating you continuously making me out to be a liar. i received a veyr dirty and scratched up playhouse NOT a great and clean condition one that you sold me. everyone who saw the house is disgusted that you have the cheek to make out i am the one being dishonest here? as you are well aware of the condition it was in and know you are being dishonest and unfair, you have received money by being dishonest, but clearly that does not bother you.

    I have replied via dispute page

    "I dispute your assertions as to the state of this item. This item had been cleaned. You collected this item in daylight, it was not raining and you had as long as you needed to check this item before paying for it. You carried each piece of the item to your car. If the item was as dirty as you state then it would have been apparent long before erecting this item. If the item was "very dirty" it would have been apparent when you inspected the item. I would have been happy to issue a full refund had you requested this and returned the item. Unfortunatly you have now sanded the item which will have caused material damage. Sanding plastic will cause scratches and thus damage to the item, Sanding plastic play toys is not a recognised cleansing technique and not one which Little Tikes reccomends.For this reason I can not now issue a full refund.You request a refund of £15, due to the unaceptable sanding of this item I can only offer a goodwill refund of £7 via cheque."

    Will see what happens now,

    I would'nt have offered her a partial refund, its like an admission of guilt then. Thing is it may well be filthy and scratched and you may have described it wrong, we don't know and theres 2 sides to every story obviously, but the bottom line is even *IF* it was and all that aside, she picked it up! She had time to look over it, I know I would have checked it thoroughly before parting with any cash, she decided she was happy and took it, whats to say it did'nt get dirty in her car anyway :P

    I would just ignore her to be honest. She inspected the item when she bought it, paid you in cash so sod her.

    I always thought it was sold as seen as well (on cash on collection deals) but ebay seem to have this dispute policy that says that if they find against you you have to refund, if you dont they can refund and set debt colection agency on you.
    I thought by offering partial refund and giving reasons why couldnt offer a full refund that it would show willing to ebay. Im not sure how harsh they are on this type of dispute

    A bit naughty, at the beginning, could you not have just said that the buyer had never turned up to buy the item, as ebay could not really prove otherwise.

    So they agree, the photos show the item, in a state that presumably they were prepared to buy from. End of?

    If ebay offer a refund, the buyer only gets it when they return the item tracked, which works when they paid via paypal.

    They would be made by ebay to return it to you in its initial condition as they paid by cash.

    I wouldn't have offered any reduction!

    Surely the fact that they've sanded a plastic house will now mean that it can't be returned in the condition they received it.
    If I were the OP I would be going down that route, how is a sanded down plastic playhouse going to be saleable?
    Chances are for some bizarre reason, they thought that it would be a good idea to sand & maybe paint it, realised that they've messed it up & are now trying to blame the seller.
    I'm hoping that the OP hasn't shot themselves in the foot by offering a partial refund, as that could perhaps be seen as an admission of guilt.
