Our taxes were needed to avoid complete financial meltdown unfortunately but I appreciate your frustration. The part nationalised bank you refer to (I am assuming the one of Scottish extraction) has to now make a profit or our collective investment will be for nought.

Regarding the huge bill you clocked up, did you not check with the insurer first to see if you would be covered and up to what amount? Most policies have some kind of limit of indemnity if indeed they do cover this kind of thing. I do appreciate your urgent need to get home and the undoubted effort and stress you would have had to go through to get there, but the airlines and insurance companies have to limit their liability somehow in this most unforeseen of events. Getting some of your money back is certainly better than nothing (a situation facing many people out there).

I do appreciate however that the support provided (and continue to be provided) by BMI was a joke however and sympathise with you here.

Just received my letter from BMIBaby declining my claim for reimbursement for my family of 5 (£1097). My next step is to go back to my travel insurers Natwest as they said they would cover me (£250 per person) if I went to the airline first.

However, I will be liable for an excess if I claim through Natwest. If people's small claims start getting paid in the courts will it be worth me chasing BMI for the liability of the excess through the same channel?

Not connected with the ash problem, but when I had to chase refunds etc for a cancelled flight with BMI I found them to be very poor in their communication skills, particularly in responding to letters.

I sent many recorded letters that I had proof were received that when I finally had a reply they denied receiving.

Due to their lack of replies and despite warnings I applied online for small claims, they soon replied to that and thus got things moving rather swiftly.

    Good luck in your pursuit.
  • bmi have now paid my expenses claims without going to court . it cost me only 35 pounds to take them to the small claims which i did through the site money claim online .any one who decided to take re routing and not had any reimbursment might think about using thios option.:j

The people who are out of pocket must limit their liability somehow, so I reckon they should go & break in to the airlines offices & steal goods to sell & pay their costs?

    Sound fair?

Oh that's right - that would be illegal, just like the airlines refusing to pay! Great post glenda!:T

  • Hi All, BMI Baby logged my claim on the 17th May today I had a reply stating they would not pay out on my claim for 8 extras days in Spain.

Put a claim into AUC in May, rang then end on June to be told they couldn't find my e mail !!!, finally found it so forwarded all copies of receipts to them, rang them this week to be told it will take around another 3 weeks before they look at it and as we were stuck in Spain my claim will be sent to Spanish Authorities .

The only way I have spoken to anyone from BMI Baby is by ringing BMI, asking to speak to the Chief Exec , PA and having her to get them to ring me, maybe thats what we should all do , perhaps they will get fed up answering calls !!! also this way saves on the premium telephone number BMI Baby tell you to ring

Stevie D - thanks for the pointer towards claims online at HMCS. It worked for me although bmibaby did not give in with good grace. After waiting for 6 weeks for a reply to my second letter, they contacted me just 3 days after I submitted the claim to Northampton County Court.

Initially they offered me a settlement which was considerably lower than what I asked for - this I rejected.

They then increased the offer slightly - this I also rejected.

Finally, the made me an offer which was close enough to what I asked for. I accepted and they duly sent me a cheque.

    Thanks again for the info.

You mentioned that your travel insurer would "cover" you to the extent of £250 per person.

I'm presuming this was delayed departure payment calculable with reference to the duration of the delayed departure.

This appears to remain outstanding for payment by the travel insurer and was wondering whether you would be following this through?

Presumably if you are planning another holiday then some additional spending money might also be handy

    Hi Shona99,

The travel insurer issue is now academic as BMIBaby have now paid out - story in full here.

It would have been interesting to see what would have happened if BMIBaby had challenged my court action and won, because my travel insurer said they would only pay out in the event of me failing to get my money back from the travel insurer. I guess by stating that they knew they were unlikely to lose...
