t-mobile/ 1st credit

My 8and half month pregnant daughter having real problems through no fault of her own from 1st Credit( t-mobiles thugs).
She's had prob's with both phone and dongle coverage, t-mobile last year guarenteed coverage and if not would take them back. That was until the time. The shop didn;t want to know. My daughter went in numerous times and got no where. She was contacted by 1st credit towards end of last yr saying she owed £500. This I paid at £50 a week til paid.(mid-January)
She heard nothing then until beginning of this week when she got a phone call saying she now owed 1st credit £947.81. She tried to explain that we had paid the £500 that initially they said she owed and that the phones and dongle had not been used at all. They gave her until tomorrow to pay up or else.
She phone today and 1st Credit would NOT listen, they were abrupt with her and ended up having her in tears. As she said to them she wasn't working now as she was 8months pregnant and all she could afford to pay was £5 a week. This they laughed at.
After phoning me in tears I then phoned 1st Credit and obviously got one of their people with no skills with public. Again he wouldn't listen and when I offered to pay for her £100 a month, he said they would not accept anything but full payment( reduced by £100 if I paid now)
Told him I would go to FSA, local MP and press and let them know how unco-operative they were. I kept informing him they have no right to speak to people they way they do and especially my 8month pregnant daughter who they twice have upset this week. He said they had informed her that this had to be paid or they'd take her to court and no offer other than full payment was enough.
Just a question...My daughter offered £5 a week which in her situation is what I would say was a 'fair'offer.Obviously I would help and offered this to 1st credit but they laughed at that.
I've emailed t-mobile to state how annoyed I am with how they deal with people who through no fault of ther own find themselves being harrassed by thugs.
Can anyone help me in trying to sort this problem out as I really don;t want my daughter in the state they have made her this week.

    a lad i work with had a problem with 1st credit and I looked into it for him sned them the letter below and see.

    he did and hasnt heard from them in 3 years

    Dear Sirs

    Re:−
    Your Ref:

    I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose £1 in payment of the statutory fee.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities, therefore if I do not receive evidence that I owe your company any monies by (enter date) , I will have no hesitation in passing your details to the Office of Fair Trading.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    Regarding your threat that a Doorstep Collector will call the owner of this property is denying you or anybody working on your behalf access onto their estate or grounds in relation to this disputed debt, should you or any agent acting for you attempt to gain access to the estate or its grounds, then you will be ignoring your denial of access and the owner of (enter address) will take legal steps to sue both you and or your agents for trespass, please also note that having a letterbox on the property gives you or anyone working on your behalf neither implied nor expressed rights to enter the properties boundaries, again any instances of trespass WILL lead the property owner to sue both yourselves or any agents working on your behalf.

    I will email the template of this letter to my daughter. I've alreading emailed Trading standards so will see what materialises now.

    The problem is in the case though is that the customer has singed an agreement for the contract.

    can you say exactly what steps she took with t-mobile to resolve this before it went to the credit agency?

    On numerous occasions she visited the Oldham Shop and many more times went to the Peterborough shop to try and sort the problem out. She also phoned their 'helpline' or customer service many times but got no where. I know it is my daughter and I am obviously biased, but if she was in the wrong with this I wouldn;t be fighting her corner. It would be a case of you made your bed now you've got to lie in it. It probably doesn;t help that my daughter isn;t outspoken but very timid and doesn;t fight for her rights

    Speak to consumer direct http://www.consumerdirect.gov.uk/ (i.e. trading standards).
    They ought to have knowledge and experience to tell you what really is the best approach to deal with this.

    After you have done that, write a complaint to T-mobile (but that is for later).

    How long after she purchased the dongle did she try to return it?

    T-Mobile do not guarantee coverage anywhere but they do operate the streetcheck guarantee wherby if the coverage doesn't match up to what is stated on the coverage checker you get a 7 day window in which you are entitled to return the equipment she would however have to return it to the store it was purchased from

    She went into the Peterborough shop within a week of purchasing it. She spent a few days in Saddleworth with me when she took the contract in Oldham shop then returned home and the saga started

    T-mobile in Oldham did the check for coverage and told her it had coverage for her address in Yaxley, but to try it when she got back there. She did ask the assistant that if she had problems could she go into the Peterborough shop and they told her yes. I am sure that if we had known that if she had problems with the connection and she had to bring back to original shop we would never have took on contract from Oldham.

    Did she specifically ask if she could return it to the peterborough store?
    What excactly did they say when she tried to return it to them?
    If she just asked "can I go there if i have any issues?" this could be construed as she can go in there for help setting it up etc
