    If an 'unprecedented situation' caused a Ryanair plane to crash (God Forbid) I wonder if Mr O'Leary would take it upon himself not to pay compensation to the victims of their families who had paid a discounted fare.

    I hope the authorities come down on this spiv like a ton of bricks.

    The compensation for travellers extra expenses should not come from Ryanair or indeed any other airline - they should come from ones travel insurance.

    1. No, I wouldn't stoop that low because when push comes to shove you know what the response will be.
    Easyjet & Flybe have both said they will pay up.

    The law is open to interpretation. We have a legal system based on precedent, that means nothing is really 'Legally set in stone' until it has been applied in court (in a technical sense of the word), this hasn't.

    Challenging the law for fairness has happened since statutes were first created. It defines the basis of the 'fair' legal system we have today.

    Like i said earlier, i expect this to go to court and it be very interesting.

    1. Easyjet's rep on the radio was backing off a little this morning on whether the legislation applied in this case, obviously considering other operators response.

    2. Tell the airlines its the law, and make them abide by it

  • I dont profess to know the answer here, I agree it seems unfair that compensation should come from the carriers pockets when they are not at fault for the situation but then for the same reason why should it be the consumer who has to suffer?

    Perhaps there should be tighter regulations on travel insurance - the obligation to purchase it (perhaps for passenger AND carrier?) and a statutory minimum cover so that the insurers cant impose impractical exclusions.

    The situation is made more complicated because the media have been using the word "compensation" when they actually mean costs associated with "duty of care".

    Compensation is a separate issue and airlines are absolved from paying this when there is an extraordinary circumstance.

    Ryanair have said they WILL pay for "reasonable, receipted expenses" after all and not limit these to the cost of the ticket.

    At least they have dropped their defiance.
