Garage threatening to take back car after they forgot to get finance forms signed!!

    Get the garage to come and pick him up and take him to their dealers. If its a chain there should be a more local dealer. I have bought a new car from a dealer in Birmingham but will sign the finance papers at a local dealer in the same chain.

    Go with the magpie cottage letter - but send a copy to the head office of the dealergroup in question along with a complaint letter.

    A salesman has forgotten to get everything signed and is now playing silly sods and throwing threats around in order to cover his backside.

    I am also guessing if he missed this he may have missed explaining various other products and services which are a legal requirement so worth reviewing the rest of your paperwork.

    Would he also miss out on any bonus the sale gives him?

    I was a car salesman for about 7 years - no longer - but would like to clarify something.

    1. The finance documents must be signed on the premises of the dealer, where the Consumer Credit Licence is registered. This is a requirement of all finance companies such as Black Horse, etc.
    2. It would not be unreasonable for him to insist the garage reimburse him to his time and fuel costs
    3. Until he has signed the docs or paid for the car, it's not his and remains the property of the dealership. It was their mistake, true, but a mistake nevertheless. No judge would award the person the car on this basis.
    4. You are not covered at this point by the CCA as you have not yet legally entered in to the contract, so are not governed by it's terms.

    Why not pitch the dealership for a tank of fuel / mats / valet etc for the inconvenience ? To be honest, I'm surprised they haven't suggested it already as a form of compenasation.
    Thanks to MSE I cleared £37k of debt in five years and I was lucky enough to meet Martin to thank him personally.

    Exactly. Anyone trying to suggest they might get the car for free really is clutching at straws.

    I don't think that is the point most responders are making.

    The thing is the dealer has cocked up and has offered no incentives to sort "their" mess out. They are just using threats.

    I think we all realise mistakes happen and if the dealer has made a mistake he should be grovelling to the buyer and at least cover out of pocket expenses, a firm apology and some gesture of goodwill (and that probably if offered early doesn't have to be very much).
