i orderd a sony tv from tesco direct priced at £399 when the drivers turned up they had a samsung tv i seid thats not the tv i orderd they seid its got your name on it if you want it sign for it so i did my son put it up while i was at work but tesco seid i need to send it back as they had sent wront tv i seid ok just send my sony 1 but they seid no we dont have your sony 1 now its out of stock anyway iv still got samsung tv but i had a new patio door fitted and yes the patio door fell on the tv where do i stand as they want receiptt tv told them iv got reciept for sony tv but my tv is a samsung iv seid i want replacement samsung which is the tv thats been damaged where do i stand

The damage to the Samsung TV is entirely your responsibility.
If you have a household contents insurance policy that covers accidental daamage, you will need to make a claim on that."You were only supposed to blow the bl**dy doors off!!"0 -
Really your should have refused delivery in the first place.
I would think you would need to claim for the broken tv on your household insurance.
You will obviously have to reimburse the shop as well as them sending yu the TV that you ordered or refund your money.
Youre going to out of pocket though if you have excess on your insurance.
The shop is not liable for that as it was you or yur household who caused the accident.make the most of it, we are only here for the weekend.

Anyways....... You took receipt of goods that weren't yours, why not reject them?.
OK so you don't reject them, common sense says you don't touch it but what did you do? Oh yes set it up. You set up something that wasn't yours and have damaged it.
You are liable for the cost and may have to pay the extra (or only be refunded the difference if it costs less) as you cannot return it. As soon as you took delivery, you were responsible for its safe keeping. If your lucky, you may be able to get reimbursed by the window company but this is a different matter and depends whose fault it was (plus it may be a little dishonest).

I believe what being asked is:-
I ordered a Sony TV from Tesco Direct. They delivered a Samsung TV in error which I queried at time of delivery. I installed the incorrect TV in my house.
Tesco then contacted me and requested that I return the Samsung TV. They also advised me that they no longer have the Sony TV in stock.
I have since damaged the Samsung TV.
What are my best options?0 -
thanks for replys my son didnt no it was wrong tv and tesco did take payment for sony tv but then seid no its out of stock and it was window company that did the damage to tv im not being dishonest i just wanted to no where i stand how can insurance replace a sony tv which i never recieved tesco havent replyed to my phone calls0

OK so how long was there in-between the set up of the TV and the damage.
Did you know the TV was there before it was damaged?
Even though your son may not have known, its still your responsibility.
Is the window company prepared to compensate?Back by no demand whatsoever.0 -
