I'm sorry PC Gabriel Kent (obviously an angel), but have I at any point said that I did not owe the company the money and that I resented them taking it???0
-
I did. This is when they said there was nothing they could do as the payment had already been 'authorised'. By who, god only knows. They did mention the 6 month thing at the time0
-
Not without authorisation from the card holder, as far as I'm aware.
That's like me falling behind with payments to a company, and them deciding to just take the whole lot owing to them from my account because they still have my card details.
Thats why I asked if the OP had any contract to state they had a repayment plan and such. Got no response.
I have to disagree with you here and say the company has the right to take the money. The OP must have given them the authorisation otherwise the company would never have the card details in the first place surely?Thank you shellsuit. Yes, I dealt with them with my card 5 months previously. I was supposed to have payment scheme with them before, but since becoming ill was having difficulty making sure I had the money in time every month. They've taken the money now and will not give me it back. Like I say, my issue isn't really with them - just wish they'd gone about it slightly differently. Issue is with the bank
And from this I imagine there is a repayment plan involved and as the OP has fallen behind on the payments the company has taken the full amount. This would be in the contract surely Shell?0 -

Im confused here. Have you purchased something? Have you paid for it? If so what is the issue? You have the goods, the company has been paid, is that correct?0 -

I see what you mean, but it would all depend on what was in the contract if there was a contract.
animmo, was there a contract? Are you not willing to name the company?Tank fly boss walk jam nitty gritty...0 -
What is it with some of the people here??? All I asked was a question and then I get abuse from other users!
The company is called BPWeb, a web hosting company. Their payments are supposed to come out of my account monthly. As I keep saying, I have no issue with them taking the money. My problem is with the bank - did they refund me or not? And why did they then charge me for being overdrawn?0 -
There was no written contract btw. The payments were supposed to come out through WorldPay, not DD0

When people go into banks and say X have taken money without authorisation, the bank has to give you the money back whilst they investigated.
The bank will then go to the company, find out why money was taken. And then 2 options will happen. The bank will either find out the money was originally taken fairly, which is what has happened to you, or the money was taken unfairly.
As the money was taken fairly, the money is then taken back out of your account and given to the company.
The overdraft charge is because it took you into your unauthorised overdraft. The banks charge you for this. All banks would have charged you for this.0 -
Thank you Lokolo for a considered response. I just wish the bank had informed me of this at the time - as I say, they told me no action could be taken in the first place and I told them I owed the money. I was therefore surprised to find the money back in my account, but figured they had re-thought their earlier statement. I stand guilty of being naive.
And thank you to those who get kicks out shouting abuse at people for no good reason. May your heads be eternally stuck up your own !!!!!!0
