Well done, you've put a lot of effort into getting information together for people and should be thanked. :T
I do think however you, and others, shouldn't get too sidelined by using the 70% banner as a form of defence. That sale only had one item at such a discount, an 8 month old MP3 player, that even at the sale price wouldn't have been too far below the trade price. This TV was released in April 2010, it would make absolutely no commercial sense to clear out the warehouse the same month they got them in stock and sell the products at a loss. If Pixmania can demonstrate the item was clearly a misprice, does that end any type of action? If so, I think that is a major stumbling block.
I'm also not entirely sure about the 'naive' approach in the description of 'Pixmania regularly has sales'. It doesn't really pay to be dishonest. You can't honestly say you did not think this was a misprice can you? If so I'm sure you must be the only person who did!

It is important to note that many consumers will have bought the item on the face of the offer. Pixmania do offer huge discounts so it is plausable for someone to have understood it to be an offer. Remember Pixmania went to town on that web page with banners showing time limited offer etc which gives the impression that you should grab a bargain whilst you can.

That's what I thought the purpose of the site was. I think the whole faux-innocence of "honest guv, i genuinely thought this £1,200 item was on sale at £200" distracts from that and is bit of a negative defence. If it can be proven that Pixmania have broken consumer trading laws by entering into a contract and breaking it, we shouldn't really need to be given tips on how we thought this television really was on sale at £200. That part of the saga should be immaterial.
Unless of course, a contract IS actually invalid if one or more of the parties it is formed between know it to be based upon an inaccuracy. I know you escape prosecution from Trading Standards if you can genuinely prove any misleading literature was a genuine mistake. I don't know if the same exists in contractual law though. Be interested to here if anyone does actually know.
If it comes down to it though, and a genuine misprice DOES actually invalidate a contract, are people actually going to proceed and claim they thought all along it was perfectly reasonable to buy a new range TV for £200?

I am one of those who thought it was an genuine bargain, i have no idea how much all these different TV's are supposed to cost, i just bought it and asked Df about it when he came in later.
I thought that with all the banners and 85% off, and the countdown timer that it was genuine.
I quickly bought one thinking they might only have a handful to sell, so i bought one quick.:TIs thankful to those who have shared their :T

That does make post number three in this thread slightly confusing?
I can't say I've ever purchased an obvious bargain then immediately posted afterwards that the retailer probably won't honour it and if I don't try I won't get...!!!
PS: I know I am intelligent, but I really fail to believe I am the only person in the cyberneticalworldnet who realised this television was mispriced at the time of ordering. Judging by the posts on here and HUKD, a lot of people thought the same. Just think it's a shame this otherwise good site doesn't address that issue, and gives the impression that we were all blindly led into this deal genuinely thinking it was the sale of the century and not at all questionable.0
