    Do you actually owe the money or not?

    the limitations act only applies if you have not made contact with them about the debt in 6 years so if you havnt so far, do not make contact with them.

    Not sure about their claims but go see CAB what to do but dont contact them. At worst they take you to court and you are made to pay for it (if you actually owe it) plus a small £30ish court fee (if you lose). You will not get a CCJ as long as you pay when the court instructs you to do so.

    At best, they are a debt collection agency or similar trying it on with scare tactics and hoping you pay before you realise you dont owe it.
    The requirement is that you have not acknowledged the debt for 6 years, not that you have not contacted them. The distinction is important, because you have to contact them to send a 'prove it' letter and many people are afraid to actually deal with problems like this because they mistakenly believe that the requirement is 'no contact' for 6 years.

    Fo you call dodging a debt a joyous way to save money?when you actually owe it?
    4 people owe me money and I am employing debt collectors. bad debtors make it very hard for the small sole traders!!

    im not a bad debtor, id pay it if i believed it was actually owed, from reading what others have said, and the statue barred limitation of 6 years old, which this debt is certainly, i just need them to prove this to me, £113 is alot of money for someone living off benefits, and if i dont owe it and they are trying to pull a fast one then it saves me money that i dont have.

    they are not sole traders, and if you have read the comments on this forum thread then youd realise that they are using underhanded tactics to get money for nothing.

    is that right do u think? no!

    I think the point is that you ARE a bad debtor and are now looking to escape liability through a principle of law.

    To be pedantic you have already admitted the debt your just trying to get out of it by using a legal device as your entitled to do, but that doesn't make it morally right.

    The bottom line is the guy has already screwed up his credit history by defaulting. Well done fella.
  • Michael Sobell used to work for Hackney Legal Services until about 18 months ago. I phoned today to make enquiries after him to see if I could find hom and was refered to the Head of LEgal Services for Hackney Council. His name is.......Graham White, How spooky is that?
