Sorry but you mentioned 6 years where did that come from ?

I would send a proof it letter...Just write to them saying something to the effect that you require them to provide you with proof of the debt and their assertion that it was from 2008

If they can then you will need to come to some accommodation with them re payment.

Do everything in writing don't entertain phone calls.

Yes, Graham White is a real firm. Its proprietor is Michael Sobell, who is also a solicitor at Hackney Council.

This firm is not to be confused to be with Graham White & Co, who are based in Bushey.

Your brother is irrelevant in all of this.

the 6 years comes from the limitations act 1983 (i think 1983) ill see about getting a letter of proof, and i'll try not to bother with phone calls.

    thanks everyone

It's irrelevant as you say the debt was in 2006/7 and they are chasing you up about it.

Why not just contact them to settle the debt and the take your brother to court to recover the money?

Ok thanks, the mobile phone contact was in my name, so the debt is in my name, i have admitted knowing about the debt as i bought the phone for my brother so to that extent yes, however i do believe that i should not be liable since its my brothers debt not mine.

I tried calling the CAB and they arent open.
    What?????
It's in YOUR name so it is YOUR debt.

Roxburghe however are a bunch of lying idiots from North of the border that will tell you anything to pay up.

Bung Roxburghe into the search facility on MSE and you will get some opinions and other people's dealings with this concern.

Reading the original post though the OP specifically state that the contract was over 6 years ago but the firm are saying they defaulted in 07/08, ie a discrepancy in the dates.
    Back by no demand whatsoever.

I get the impression the OP isn't sure about this. When I asked the OP for clarification about this 6 years they mentioned originally, they just responded about the limitations act.
