Advice Required please - 3 questions

I would like some advice please, regarding migration to ESA and my personal circumstances.
I am asking about when the government eventually migrate people across from IB to ESA.

  • I have been on incapacity benefit since 2004, and my NI has been paid automatically with this.
  • I am a homeowner, but do not currently get help with mortgage, as I dont qualify.
  • I get some council tax benefit.
  • I receive an occupational pension of £400.00 per month.
If, the government still declare me unfit for work at the time of migration, what type of ESA will I get please?

As I am on a pension, how much ESA would I get?
Would I be entitiled to other help.

I am probably being paranoid, but my fear is that I will be expected to pay my mortgage, bills and food from my 400.00 a month pension, which of course would be impossible, but, like I say, I am probably just being paranoid and would be greatful for some advice on this please.

    you will get transional protection
  • unless you live in the greater manchester area,where the transitions will be done starting 0ct.`10,then you should be moved to esa when your current I/B claim expires(when your next pca would be due)
    As Richard says providing you pass the new wca for esa then you will have transitional protection which will run till 2020

    You will receive contribution based ESA if you pass the WCA.

    Your ESA would be reduced by the same amount that your IB is reduced now due your pension.

    • I have not worked for seven yrs - how would I get contributions based ESA.
    • If my JSA would be wiped out how come my ESA wouldnt be wiped out?
    • Could someone tell me exactly what figure ESA I would get pls?

    Like the rest of us on IVB and IB?

    We are losing money every week as of last year (2009) when the goverment decided that additional pensions based on NI contributions (IVB pre `95) and age allowances (IB post `95) are going to be reduced to the same rate as ESA.

    Transitional protection has been removed by our current goverment and I cant see the winners of the next election rectifiying it, its going to cost me £1000 per year!

    So, exactly, how much ESA would I get?
    How come the ESA wouldn't be wiped out, yet if I went on JSA it would?
    How come I would get contributions based ESA if I have been on benefits the last seven years?

    As you are on contribution based IB you will be transferred to contribution based ESA if you pass the WCA.

    The rules for pensions and JSA and ESA are different and the possible deductions are different.

    The amount of ESA you receive would depend on when/if you are transferred.

    Yes everyone will eventually be transferred to ESA.

    I do not know how much you will get as it depends when you are transferred and the rates at the time but you will continue to have your ESA reduced as you do with IB due to your pension.
