Care and assistance for airline passengers

I could do with a few clarifications here if anybody can help .....

    1. Regarding the original post, doesn't the introductory clauses ("Whereas... item 14) limit the airlines obligations ? .... or is this wording covering the pre-existing position that is then amended/clarified in the following Articles ?

    2. Assuming the airlines obligations aren't limited as above, then am I right in thinking Article 8 (refund) and Article 9 (care) are not mutually exclusive ? - in my case I incurred 2 days of hotel/meals costs and have now cancelled after managing to catch a ferry - am I correct thinking I can still claim for "care" costs even though I've now cancelled, 2 days after original flight was due ?

    3. Can I claim for my £600 ferry cost ? ... I think the answer is no as I can't see anything in EC Reg 261 that covers it, but BBC website is suggesting I can ... I can't post link as I'm a new user here, but look for the "Air passenger rights" page on BBC, specifically the third "Key Point" on that page.

It may be relevant that my ferry costs (16 hours, 17:30 - 09:00) included overnight cabin accomodation (though charge for this wasn't separately itemised).

For info my airline was KLM and I was stranded at Schiphol after arriving from San Francisco Thurs morning, until Sat evening when I managed to catch a ferry .... KLM gave us 1 x 10EUR meal voucher each on Thursday morning, then flatly refused to provide any further assistance for next 48 hours; even when confronted directly with written EC Reg.

    1. Recital 14 covers circumstances that may apply to the additional compensation available under Article 5 & 7, not article 9.
    2. In this instance you should be able to claim for the hotels etc up to the point you asked for a refund/cancelled.
    3. If you have cancelled and thereby received or will receive a refund you will not get your ferry fare back.

Thanks for very prompt reply !....

    1. Okay great, but where does it state this is the case ? ... maybe I'm being dumb it doesn't seem to read this way
    2. As I thought/hoped - thanks
    3. As expected; fortunately the flight refund plus "inconvenience money" from my insurer @ £25/head per 12-hours should just about cover it anyway

    Thanks again
