well my point is, even if it was an error, do they or dont they have an obligation to sell it for the price stated on the product listing
http://en.wikipedia.org/wiki/Invitation_to_treat
"A shop owner displaying their goods for sale is generally making an invitation to treat (Pharmaceutical Society of Great Britain v Boots Cash Chemists (Southern) Ltd [1953] 1 QB 401). They are not obliged to sell the goods to anyone who is willing to pay for them, even if additional signage such as "special offer" accompanies the display of the goods."
Same applies to online shops as far as I'm aware. By showing a product for sale on the website at a certain price (even £0), that is only an invitation to treat.
Finally, I'm sure a legal eagle on here will correct me if I'm wrong, but in addition to the above point re the lack of an actual offer being made by the shop (since it is only considered an invitation to treat, not an offer), under common law, in order for a binding contract to occur I believe there has to be valid consideration. Therefore if you did not pay anything, there is no consideration & no binding contract.0 -

however, returning from work this evening i received this email
Dear Lucy,
You recently ordered a bikini from our website. Due to an internal error it was put through the shopping cart as costing zero pounds. We have now rectified the situation so if you still wish to own the bikini you will have to order it through the website again. Thank you.
Best Wishes,

what are my rights?
this was their mistake, which they have admitted.
and i received a confirmation email.
are they not now obliged to send me this product for the price stated?
I'm sure i remember a story of a woman buying a camera for 99p instead of £99
Oh come on!!!You thought it 'was maybe a great promotionor something' just a random £0.00 looks like a promotion does it?You didn' buy anything and I find it ridiculous that you are even askingthe question.
If something is showing as £0.00 it's pretty obvious that it's a mistakeIf women are birds and freedom is flight are trapped women Dodos?0 -
I posted earlier on in this thread that it was stupid to assume the £0.00 was a promotion, it got thanked a few times as well but I appear to have had this post removed, I think maybe a moderator was over zealous this morning.Oh come on!!!You thought it 'was maybe a great promotionor something' just a random £0.00 looks like a promotion does it?0 -
The only thing they confirmed was your order - i.e your offer. Your offer was then rejected.
If you want the goods you have to make a fresh offer - again, if the price was £19.99 and you ordered (offered) £19.99 they could still reject it.0 -

Yes they do have to supply you with your ordered goods. I would get in touch with Trading Standards and let these people be taught a lesson. We should get the police round to smash down their doors and take them to Dartmoor. After that, give em their P45swell my point is, even if it was an error, do they or dont they have an obligation to sell it for the price stated on the product listing
