    I've just noticed in your original post that you say that the ring was purchased in the sale.
    So to get you a different ring in the correct size may well have been more expensive.
    Could this be what they were saying about the difference in price?

    I still think the owner of the shop was to blame by assuring you that the original ring could be re-sized - it's hard to understand why she was so clueless.

    If you take rl290's way forward, your letter should be concise, to-the-point, factual and un-emotional.

    Regardless of whether the ring is worth less i too would not be happy.

    I would insist on a refund and go else where... at the end of the day if they cannot be sure of having the ring back to you before the wedding whats the point???

    The Facts:

    The ring was purchased and became the property of the buyer.

    It was the wrong size, but was purchased on the express understanding that it could be resized. This is a contract term.

    As agreed, the buyer later returned the ring to the jeweller for resizing. The ring that came back was not the original, a fact admitted by the jeweller.

    The substitution was made without the owners consent.

    The jeweller had no intention of returning the original ring.

    The new ring had fewer stones [15 as opposed to 18, and of lower overall caratage]. The qualitative difference, if any, is not known. The stones were not from the original ring, as the new ring was a substitution.

    When the customer complained, the jeweller agreed to see if some stones [3] from the first ring could be fitted in order to make up the original number [18].

    When the customer stated that if this was not possible, she wanted the 3 loose stones, this was refused.

    The jeweller has broken the purchase contract and has technically committed theft.

    Way forward: Complete refund plus compensation. Sue in small claims court if necessary.

    thank you for all of your replies. we have been givien the contact details of the trades body for jewellers. I am going to contact them as i got no where witht he jeweller. they are refusing to refund.


    So i am going to reprt them to the trades body and show them my certificates. If that goes nowhere i will go through small claims :)
