    Just a quick calculation:
    3 diamonds weigh .25 carat so they are 8 points each.
    So the total diamond weight of your original ring was around 1.44 carat and is now less than 1 carat (.92).

    Is this what you are saying?
    Has the jeweller given you a new certificate stating that the ring you now have (15 diamonds) is only .92ct (ish)?

    If you have this in your possession and also the original certificate, then I think it's not unreasonable to ask the jeweller for some of the money back that you've paid.

    Have you put these facts to the jeweller in a calm, polite manner?


    hi, when i say i kicked up a stink i wasn't impolite we just and i wasn't angry or verbally abusive to the lady. i just said to her what she was saying to me wasn't correct (she tried to say the ring i took in had 15 orignally too).

    i do have the certificates and we did ask or either money back or the diamonds back.

    the original ring was 1.49 carats, the new ring is 1.24

    I think you'll find 1.44 - .25 is actually 1.19...

    So why not take the 2 certificates in:
    1. 18 diamonds weight 1.49
    2. 15 diamonds weight 1.24
    and ask for the difference in price back?

    OK, have you said (I KNOW you said you weren't abusive but you did say you 'caused a bit of a stink' and 'kicked up a huge stink' which doesn't sound like you were the politest customer making a complaint):

    You charged me for a ring with 1.49 carat of diamonds.
    You have supplied me with a ring with 1.24 carat of diamonds.
    I have written proof of this.
    I want a refund of the difference.

    Plain and simple as that.

    If you have, what is their specific reason for not refunding the difference?

    Check out the Trades Description Act.
    Does that cover you?
    If so, throw that in as well.

    I get the feeling that you may have not been as clear as you say about exactly what you want from this jeweller.

    i may not have worded it correctly, but what i meant by it was i didnt accept what she was telling me, and i didnt agree. i was in no way rude. i dint raise my voice, i was very matter of factly, that i did accept what she was saying was the case and that i wanted back what was mine.

    There specifc reason for not refunding was that it cost them a lot of money to exchange the ring. Which i said unforuntely that is not my fault as i i was sold the ring under the impression it could be resized. im not a jeweller and didnt know at the time that the ring couldnt be re sized.

    My main points to the jeweller were:

    1/ i bought a ring, told to come back in 3 months for re sizing took the ring away with me.
    2/ took the ring in, told cant be resizes buit agreed it was their mistake to say it was so offered to try and resize or remould my ring to a new one. She even discussed the extra platinum going round the under side of the ring.
    3/ took receipt for ring that stated, ring sent away for resize or remoulded.
    4/ ring comes back exchanged for a smaller one less diamonds.
    5/ discussion with lady was polite, i asked what happened to the other diamonds, she said she would find out and give me a call.
    6/ Get the call, go into shop, she said that remoulding would have cost them too much so they exchanged the ring. i said it wasn't really my fault the ring had to be remoulded and i wasnt under told the ring was going to be exchanged. She then said to me 'i told you it would be exchanged', i said, i'm sorry but i have my receipt which states otherwise and as the ring belonged to me and the request was for resize or remould that i should get my property back.
    7/ She said no, they cant do. At which point we said we didnt want the whole experience ruined as it had been lovely up until then, but it left a bad taste in our mouthes when you give someone something that belongs to you and they replace it with something less.
    8/ she offerd to take the ring back, and try and get them to put the extra stones in, but couldn't guaruntee it and if they couldn't fit them in, they ould not give them loose either. i said ok, could we try and get the extra stones in, she said fine, but there is no guaruntee you will have it back for the wedding. im getting married in 3 weeks. I then asked for a refund. She said no.

    All i want from the jeweller is what was orignally mine. the ring and all the diamonds it originally came with

    Why don't you just take the ring back, and ask for a FULL refund?

    (then take your money elsewhere to a shop that values their customers!).

    Given they probably didn't even try to resize the ring or remould it, how on earth has it cost them money?

    If they won't even refund the difference in price, then I would consider a small claims court letter...

    now I'd call bollox on that platinum prices were about 1450-1500 usd/troy ounce in Dec and 1700 now so yes they're higher but on a ring which probably weights all of about 4-5 grams and you're talking at most of about £8/gram difference (less the smaller/lighter ring) and there's next to no difference.

    The action forward seems obvious - a written letter (not another face-to-face/telephone discussion) with your demands, and then formal action (contact consumer direct and go through the small claims court). However, first you have to decide on what you want. Either:
    1) A refund of the entire amount of the ring so you can take your custom elsewhere
    2) A refund of the difference in value of the ring you bought and the ring you have been supplied with. Ideally you will find out what the price of there 2 different rings was at the time of purchase (do you have an old catalogue?)

    Once you have decided on one of the two options above (and you must make your mind up on one or the other), write a formal letter to the shop/company explaining factually what was agreed and what happened, with photocopies of the documentation you have, your demand (option 1 or 2 above) and let them know that if you do not hear back within 2 weeks you will have to pursue formal action.
