    Asda are excellent with the receipt though, I've taken things back just on 12 months old and been given a no quibble refund.

    You know what, only one person has clearly advised me regarding the sale of goods act, yet there has been a flurry of replies on all sorts of matters.
    All I wanted to know was:
    "Now my understanding was if you want a refund, take proof of purchase, but for an exchange the faulty goods would suffice as long as it wasn't due to wear and tear." Am I off beam here?
    I ask this because when I buy tools (my main retail action other than food shopping, which I always eat, so no returns) and they fail due to manufacturing faults I get a replacement FoC without needing to dig out my receipt.

    Amistoso- I was taken aback as when I worked in retail I was always instructed that for an exchange of faulty goods proof of purchase was not necessary- especially on own branded goods. All the same, thanks for your fatuous reply on this being a mountain made out of a molehill. I am in no way in dispute with ASDA, nor was I rude or insulting to anyone. I was simply taken aback i.e. surprised.
    Mupette- I've not got a cob on with ASDA, in fact I am questioning my own understanding of retail related legislation here. This ink was ASDA branded and was bought from ASDA.
    Cool Username, you suggest that I have made an argument. I haven't I'm looking to improve my own understanding. You also imply I have made a value judgement on the operative who served me, but in doing so have made a value judgement yourself upon me. I may well have written 'operative' but that is pretty cold, 'young person' could have been used, but would not be 100% politically correct, however I chose 'Kid' for its brevity. I hope this satisfies your query. However on from that I coined the term "Age is no measure of wisdom" for the young persons' workforce and for use in schools to mediate between pupils and teachers. I'm afraid you have made an assumption on my character using only a single post on an internet thread.

    Yes or no would be good and perhaps even a pointer to the relevant section of a particular piece of legislation.

    Right I've chopped out the bit that applies to me in order to answer you. I'll do this bit by bit since there's quite a lot to get through.

    I'm not sure where I suggested that you've made an argument - I merely asked why people posting about what they perceive as bad customer service or an injustice of some sort tend to refer to a "kid behind the counter" as if that is relevant to the point they are making - presumably it is in order to promote the idea that the "kid" has given them the wrong answer because they are young and inexperienced.

    I had no idea this would cause anyone so much difficulty - might I suggest 'member of staff' or 'sales assistant'? You refer to considering writing "young person" but again, why does the age of the staff member even enter into the equation?

    For example, you have written "old woman" if the member of staff had been a woman in her sixties?

    Again I don't feel I've made these "assumptions on your character" that you speak of, although if I was going to do such a thing then the posts you make on an internet thread are the only things I'm able to go by since I don't know you personally.

    Yes you are wrong. The SOGA applies to the consumer, without proof of postage there is nothing to show that you are in fact the consumer or whether you even came by the item legitimately. Is that clear enough for you.

    You have already been told that you don't need a receipt - alternative suitable proof of purchase will do. Stop repeating and start listening!

    The burden is on you to show proof of purchase - otherwise the law cannot help you. The "own brand" item wasn't necessarily even bought from the store by anyone. It could have been stolen, for example.
