    Hi Nick,

    If it’s been a while since your last appointment you will be given a new reference number anyway, so better to call the helpline. Their number is 0800 138 1111.

    Back in 2008 my Husband was made redundant so started his own business as a sole trader. Obviously we fell behind with payments, got into further debt and last year entered into a DMP with a company who charges for their services (stupid i know). Fortunately my Husband has been doing very well and we are now able to resume the payments we were originally making. Only thing is, I don't have a clue where to start! Do I make larger payments through the DMP company? If I cancel with the DMP company, which I would prefer, do I just ring the creditors and explain? Will they rearrange the payments to include the missed payments etc. or will they allow us to pay the normal amounts but extend the term? Any ideas would be greatly appreciated

    Hi I have been on a DMP with CCCS since October 2009. I have debt with three credit card companies EGG, Barclaycard and MBNA. All three stopped charging interest and late payment fees virtually right away. I have just received a statment from Barclaycard and they have started to charge me interest again. What do I do?

    Just a quick question please. I am about to start a DMP. I owe over 25k to RBS and the monthly payment being offered is very low in comparison to the debt. I have a mortgage which has equity but is in joint names (debt is in my name only)
    What are the chances of the company attempting to take a charging order rather than exepting the DMP?

    Panicking as really dont want a charging order on the house.

    Hi i was wondering if someone could tell me how long a debt collector has to supply the information requested in this letter,
    Statute Barred Letter (England only)

    Dear Sirs,

    Re: Statute Barred Account - Numbered - XXXXXXXXXXXXXXXX

    You have contacted me regarding the account with the above reference number, which you claim is owed by myself.

    I would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".

    I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".

    The last acknowledgement to this debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are no longer able to take any action against me to recover the alleged amount claimed.

    The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".

    I await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.

    I have a DMP with CCCS and have 3 creditors. Credit card, bank and store card. I have paid 2 payments so far. The credit card co althouigh have declined the offer have frozon my interest etc. The bank who I owe the most money too have not. The interest on my loan is stagering. As the bank have said no, CCCS are still paying them on my behalf, will they continue to add interest? it worries me that I am going to be paying my debits for many many years. I know CCCS origionally said 11. To add to this the bank or the credit card co have not contacted me. What would be the likely hood that that they will take it further? I hope you can help, its worrrying me like mad.

    It’s great to hear that your circumstances are improving!:)

    You could cancel the arrangement you have at the moment with the fee charging company as the money you are paying as a fee to them can then go towards paying off your debts.
    You would then need to contact the creditors and inform them that you wish to continue making the payments yourself.
    If you are able to make the minimum payments, but nothing off the arrears, then write and inform them.
    If you are able to maintain the minimum payments, it is likely that they will start to charge interest again
    If you are still unable to make the minimum payments and need to continue reduced payments, then they will need a copy of your income and expenditure.

    I would recommend that you call our client support team.
    Unfortunately, the creditors are able to start charging interest again.
    It may be that they need a review of your situation and an update of your budget, as it is more than six months since you started your plan.

    Hi freshstart 2010 and thank you for your message.

    There are no hard and fast rules on this. It would depend entirely on the creditor.
    If your house is owned in joint names and the debt is in your name only, a charging order could be applied to your share of the property.
    If you have a joint mortgage, all parties who have an interest in the property are informed of an interim charging order application, including your mortgage and secured loan companies and your partner.
    If you do receive notification that they are going for a charge, then you should contact us for further help and advice.
