hi currently setting up dmp with cccs after being with a company that charged it is supposed to be set up in time for first payment on the 1st of feb but cccs wrote and needed more infk which i sent and they received yest. my question is will it be set up in time for the 1st or wilk i have to send token payments again

I am currently going through a redetermination of a CCJ that was issued last year (by MBNA). The hearing was transferred to a County Court local to me and late last year I received a Notice of Hearing of my application for redetermination. Do I need to attend this hearing? I did contact the agency (a non-profit charity) that are dealing with my creditors a couple of weeks ago by letter to ask the same question and to send them copies of the documents for their files. Unfortunately I heard nothing from them, so phoned earlier this week to be told that the people dealing with my case won't be back in the office until tomorrow - the date of the hearing. I'd prefer not to go as there is nothing further that I can add to the financial documents that were sent to the court.

If you have been given the option to attend a hearing it is usually advisable to go as you’ll be given the opportunity to put your case forward. Even though you have already sent your details, you will be showing willing by turning up and the judge is likely to look at this favourably.

Thanks for your previous help, I just have a couple of questions regarding my husbands debt.
We have sent token letters to his creditors as suggested in our cccs booklet, but have, as yet not heard anything from any of them, do we go ahead with the token payment, or our usual minimum payment?
Also I work for one of the companies that my husband has a debt with, do I need to notify them? (It is a bank). The debt is not in joint names but I'm concerned this will effect my accounts which are just in my name?

Even if you haven’t heard anything back your husband should start making the minimum payments – otherwise you will be leaving yourselves short on your priorities.
With regards to notifying your employer – this shouldn’t affect you provided that you don’t have any joint finances or accounts with them.

Do debt collection companies often wait until just prior to a debt being statute barred (mine are 5 1/2 years old) before getting a CCJ? - guess work maybe but if you have any knowledge or experience about this i would be greatful of a reply...I now need to decide bankruptcy or to pay off a tax debt i cant avoid and if i get another CCJ i would go beankrupt, so it then wouldnt be worth me paying the tax debt. ty, Carlos.

Hello!
Me and hubby are just in he process of looking into an IVA - we are currently speaking to the CAB. We live in a 2 bedroom terrace and have 2 children (4+2) who are a boy and a girl. Obviously we need to move to a 3 bedroom accommodation. Our only option will be to rent our current property out and move ourselves into bigger rented accommodation - this is because we cant get another mortgage and we cant sell the house!
My question is this:
Should we do this BEFORE we go into an IVA or not??
Our mortgage is only £415 per month but if we were to rent a bigger accommodation it would cost approx £150 - 250 per month more.
Any advice would be helpful x

Have you spoken to your advisor at the CAB about this? If you expect your outgoings to change, it’s best to discuss this with them - if your expenditure goes up, an IVA may no longer be your best option. I can’t say for certain whether this will be the case in your situation as I don’t have enough details, but if you discuss this with your advisor they will be able to help.

Im still waiting on capital one to send me a statment of my debt, but still no sign of them sending me anything. I was wondering if im able to take capital one of my plan and add it back on my plan when I have sorted getting a statment from them

Unfortunately, you can’t start a plan without including all of your creditors. Did you send your request recorded delivery?
I’d recommend that you call our support team as they may be able to keep this particular debt on hold, but you would need to discuss the reasons with them.

If Lowell bought the debt from Capital One then they will have the right to update your credit file and add a default if you are behind on payments.
They will usually send you a default notice after three to six missed payments. You are given at least fourteen days to pay.
You should have received notification from them that the default had been issued.
If you feel that the default has been added unfairly then you could put your grievance in writing to them.
You could also contact the Information Commissioner Office. I have attached a link to a booklet called ‘Credit Explained’ which has the address of the ICO and will also give you further information

Many thanks for reply which was really helpful - and pretty much confirms what I was already thinking! Just a couple of questions if you don't mind - first, is it OK to call the CCCS as you suggest when I have a DMP with Payplan? Or should I ring them? Also, you don't mention whether a DMP is just as damaging to my credit file as a CCJ - that might make a difference to me so I'd be grateful for advice on that. Thanks again.

I’m sorry we missed your post earlier.
You are more than welcome to call us for advice, although if Payplan already have your information, you may find it easier to contact them.
A DMP itself won’t affect your credit file, but the consequences of defaulting on your credit agreements will. So defaults and CCJs will all make a difference.

Any advice on this would be really helpful, I'm on the verge of seeking legal advice, but thought I'd try here first.
Where to start!! I basically owed Croydon Council £2600 approx an received letters from Jacobs in April stating various amounts that were owed. I emailled them and they told me to contact the bailiff it had been assigned to who eventually visited my home in May and left a letter. I contacted him, made an inital payment and arranged to meet with him to discuss the outstanding amount, as they various amounts he was quoting did not match the information I had received.
He came back to my home in May and we discussed and agreed what was owed. He levied some of my goods (noooooooooo I hear you cry!!) I realise now I shouldn't have done that. We came to an arrangement to pay off the debt. He did not leave me with a notice of seizure so I therefore was not aware of what there charges were.
The arrangement ended in October, when I made the final payment and to my knowledge that was the end of it. I then received a visit 2 months later from a different bailiff stating I still owed over £900!!!!
(Im sorry this does go on a bit!!!) I contacted the head office and request a breakdown of all payments made and charges. This is when I discover out of the £2600 I have paid they have taken £770 in charges, which means I stll owe Croydon Council £770. My query is regarding these charges. Firstly they have charged me for visits that just didn't happen. The days they are stating they visited are the days I called the bailliff to pay him. They never attended with a van and they charge me 3 times for visiting 1 day, this is apparently becuase it is 3 liaibility orders, but how can they charge you for visiting 3 times in one day!!
I have written to them, but they have written back basically ignoring all my points an stating it has been passed to another bailiff. What is m y next move on this???? Any help would be greatly appreciated.0 -

I'm in a dmp with cccs at present and things are ticking along nicely. I am hoping to do a uni course in the future, initially I intended to do this once my dmp has ended (approx 7 yrs time). As things with my job are now uncertain and I fear I may face redundancy in the next 12 months, I am considering bringing my plans forward. If I was to proceed with the uni course, would I be unable to take out a student loan as this is further credit? I know student loans are treated differently to other debts when repaying but are they allowed as an income to live off through uni?
