On jsa but not recieved my tax rebate even though 5th april has passed!! :@

Ive been unemployed since november and been on jsa.

I am entitled to a tax rebate of £967, and had been told by the jobcentre staff that its paid automatically with the 1st jsa payment after 5th april.

However when i phoned up the head office in hastings today to check if my tax rebate had been sent out along with the jsa that would have been paid to me this morning,
i was told that their system is showing nothing about me getting a tax rebate!!

And they told me to phone the tax office to sort it out with them.

However ive spent the last 2 n half hours trying to repeatedly call the tax office, yet every single time i call i get the same automated message ''we are very busy, you should call back later'',
and then it cuts you off instead of putting you into a call waiting queue!!:mad:

I urgently need that money to pay various bills like electricty, and im entitled to it,
but does anyone know any other way i can get through to the tax office??

As their call centre staff are just totally useless at answering the phone ever, yet still charge you to make each call cos of the 0845!!

I finally managed to get through to a tax-office, however the man said that because i've been claiming jsa which is taxable income,
they the tax office need me to send them a 'statement' from the jobcentre showing how much money i've recieved in benefits this year.

Does anyone know how i can get this kinda statement though please??

    Thanks

Friend of mine claims incapacity benefit and always receives a P60 each year from Job Centre Plus. The P60 usually arrives some time in May, which is a real pain as it holds everything up.

I have just rung today and asked for details of taxable benefit for the tax year 2009/2010 to speed things up this year rather than wait for the P60 as the tax refund is urgently needed.

Once I receive this figure I then write to the Inland Revenue with the information and ask for a tax rebate.

Be assured if you do not write the required letter it does not automatically come, the rebate has to be claimed. Surprisingly enough it comes through fairly quickly.

    Hope this helps.

But dont hold your breath, the tax office are inundated with this sort of thing at the beginning of April.

Took them 3 months to sort my oH out last year.
make the most of it, we are only here for the weekend.

OP have a look on Saynoto0870 to find an alternative number
Often you can ring the 01 or 02 number after 6 or 7pm, so lots of these calls are free.

Thanks, i was using sayno for the number,
and i managed to get through to a tax office in twickhen (not not tax office), where the man answered straight away and was extremely helpful.

He spent about 10-15minutes checking through all the hrmc's systems and database's to findout my work history,
and he told me that the reason why i haven't got a tax rebate is because my previous employer never sent my p45 to the tax office!!

And so the tax office have no information about that employement.

The employer sent me my p45 when i left, which i gave to my local jobcentre.

And they had given me payslips which show my PAYE reference number, tax code, and NI/Tax deductions.

However he just said that without my p45 the tax office cant issue a rebate, as they have no record of my employment or details about earnings and tax.

I asked if i phone up my previous employer and ask them to send a copy of my p45 to the tax office would that sort it,
but he said the employer probably wouldnt have a duplicate copy of my p45.

And then he just gave me another 0845 number (0845 302 1408) to call which would be my tax office,
and to ask them to contact my previous employer to findout the details.

Im going to try doing that now, however that seems quite long-winded that after i phone them they will callup the company i used to work for and ask for details about me, just so they can pay me back nearly £1,000. :(

Ok well ive managed to establish the fact now that i havent got tax rebate on system for me yet as tax office have no record of my employment with last company,
as the company never sent them a P45 for me.

(When i started i had no p45, and so they had given me a p46 which i filled in and gave back to them)

So now currently there is 1 p45 form, which was given to me, which i gave to the jobcentre,
but which needs to be given to the tax office...

So does anyone know what route i should take now??

Call the jobcentre head-office and ask for a copy of my p45 to be posted to me?

Call the JC and ask them to phone up tax office and tell them the details of my p45 form?

Call my previous employer and ask them to contact tax office and tell them the details of my employment and tax? (If they have them on file still)

Or call the tax office (if i can get through) and ask them to phone either JC or ex-employer and ask for the p45 details??

    Thanks

Speak to your previous employer and ask for a statement of earnings (they cannot duplicate a P45)

Then (copy first) send this to HMRC and ask them to look into your rebate.

You will have to do all the leg work yourself as each 'company' will not discuss you with the other due to data protection.

You would never receive a rebate after 5th April either as this is now the new tax year and it would have to be dealt with by HMRC.

One question though - if HMRC dont know that you worked for employer 'A' then how can employer 'A' pay your deductions to HMRC? I would imagine all will be updated re your employment there once they submit their year end reports - either that or employer 'A' are 'dodgy'!!

    Hi Firey

Firstly the P45 you submitted to JCP for claiming JSA is applied to the JSA system (JSA is a taxable benefit), this is because tax is a cumulative figure throughout the tax year, hence the need to supply it when entering a new job/ claiming benefits.

At the end of the tax year your employer (JCP in this case) will issue you with a P45 and p60 detailing tax paid etc for the last year. JCP systems automatically link with HMRC systems.

Given that the tax year finished on Monday and Monday was a public holiday and even if you were in employment it takes at least until mid-may for P60's to be issued, you will have another while to wait. Plus HMRC are so busy at this time of year.

If you are entitled to it then HMRC will assess when you apply but again this will be a waiting game.

    Hi and thanks for replies.

Will i get a p60 from the jobcentre, even though im still claiming jsa (and my total income for the tax-year just ended is under the £6,700?? (So i shouldnt be a tax-payer).

From all the info on the net, and from what the jobcentre had said, you aren't meant to have to 'apply' for your tax-rebate when you are claiming jsa,
its meant to be an automatic thing which just happens and is paid automatically with the 1st jsa payment after 5th april.

I was on the emergency tax code all during employment though, and even on jsa i got a letter from hmrc saying my tax code is BR while on jsa.
So im guessing it must be that the employer didnt pass on my p46 when it was created to the tax office, or my p45.

I phoned up my previous employer's HR department though and they have said that their accounting department has passed on my p45 to the tax office (the tax details part of it whihc they still have on file).

She didnt know if they post it, email it, or fax it to them, or which tax office they were sending it to even,
but it should be arrived wherever they sent it by wednesday,
and so il be trying to get the system checked again then.

Yes you will get a P60 from the JCP - this is a statement of all tax, NI etc paid for the past tax year. JSA is a taxable benefit see below from HMRC (
EIM76222 - Social security benefits: how much jobseeker's allowance is taxable

    Part 10 Chapters 3 and 4 ITEPA 2003

Jobseeker's allowance (JSA) is taxable regardless of whether someone is entitled to contribution based JSA or income based JSA. There are special rules for deciding how much of the JSA someone receives is taxable.

The amount of JSA that is taxable is the lower of:
    • the amount the person receives and
    • the taxable maximum.
The amount of the taxable maximum depends on whether someone is claiming as a single person or as a couple.
    Single person

The taxable maximum is the basic personal allowance that person would receive if he or she qualified for contribution based JSA.
    Couple

The taxable maximum is the basic personal allowance that person would receive if he or she was entitled to income based JSA. The JSA paid is the taxable income of the person who makes the claim even if she or he receives extra benefit for their husband, wife, civil partner or as a couple.
    Example 1

A woman aged 21 lives alone with her six year old child. She has never paid National Insurance contributions and qualifies for income based JSA. During 2002/03 she receives a total of £87.45 per week made up as follows:
Basic JSA personal allowance for a lone parent aged 21£53.95Premium for dependent child£33.50Total£87.45
The taxable maximum is the basic personal allowance she would have received had she qualified for contribution based JSA, which is £53.95. As this is less than the amount of benefit she actually receives, her taxable benefit is £53.95 per week.
    Example 2

A man lives with his wife (both are aged 30) and six year old child and qualifies for contribution based JSA. During 2002/03 he receives a total of £118.15 per week made up of:
Basic JSA personal allowance for a couple£84.65Premium for dependent child£33.50Total£118.15
The taxable maximum is the basic personal allowance he would have received had he qualified for income based JSA, which is £84.65. As this is less than the amount of benefit he receives, his taxable benefit is £84.65 per week)

If you are due a rebate and you are still on JSA then this will be paid directly from JSA - separate from your JSA payment.

It is not correct that this is paid in the 1st payment after 5/04/10. The tax returns for employers and JCP to HMRC have up to end of April each year I think and its usually mid-May / end of May at the earliest before a rebate will be paid.
